Eastland This Indenture made and entered into this the Tenth day of April AD 1861, by and between Jas W Sharp party of the first part, and OR Eastland party of the second part, trustee as hereinafter mentioned, and M D Graham agent for A.E. Harper J.C. Harper A.L. Harper & W A Gatewood party of the third part, Witnesseth. That whereas the said party of the first part is now indebted to the said party of the third part in the sum of Five Hundred dollars for money paid for him and in general dealings by note; and whereas the said party of the first part desirous of securing not ony his present indebtedness to the said party of the third part, but also any and all future indebtedness he may incur or contract with the said party of the third part: This indenture now witnesses that in consideration of the premises and the sum of Ten dollars paid by the said party of the second part to the said party of the first part, the receipt of which is hereby acknowledged, the party of the first part has this day by these presents, sold aliened and conveyed to the party of the second part the following described property to with, Lots No three and four Block No 10 and also Block No 15 in forest Miss now occupied by said Sharp as a livery stable said Lots being in Section 16 Township Six Range Eight East. To have and to hold the same upon the following special trust; that the said party of the second part trustee as aforesaid, shall permit the said party of the first part to retain the possession and use of the said Lots until default is made by the said party of the first part, in his agreement and stipulations with the said party of the third part, to wit; that if the said party of the first part pays to the said party of the third part all his present indebtedness to said part of third part and also all additional indebtedness that he may _____ on or before the first day of January AD 1862, on or at that date, these obligations and conveyances to be void otherwise to remain in full force and virtue and it is also understood, that this conveyance, if not foreclosed on or at the first day of January AD 1862, with the like effect as to previous dealings and if the said party of the first part shall, on demand of a final settlement by the party of the third part pay all indebtedness then due, then this obligation and conveyance also to be void but otherwise to remain in full force and virtue and on request of the party of the third part, the said party of the second part shall sell for cash, at the door of the Court-house of the County of Scott in the state of Mississippi all of the property therein described, herein conveyed after giving thirty days notice of such sale by posting advertisement thereof on the door of the Court House and two other places in the County and from the proceeds of said sale said trustee shall pay first the expenses of this trust, second the debts due the said party of the third part, and third the surplus of any to the party of the first part.
