Petty Filed for record March 1st 1861 To J H Stribling CT Jas D Jones Clerk This Indenture made and entered into the second day of January AD 1861 between T. M. Petty of the first part and James H. Stribling County Treasurer of Scott County and his successors in office of the second part, Witnesseth: That the said party of the first part for and consideration of the sum of One Hundred dollars loaned to the said party of the first part, By the Board of Police of Scott County State of Mississippi – being a portion of the School funds of said County loaned to the said party of the first part in accordance with the acts of the legislature of the State of Mississippi, made and provided now this Indenture witnesseth; that the said party of the first part for and in consideration of the sum of money loaned aforesaid the receipt whereof is hereby acknowledged, and the better to secure the payment thereof does hereby give bargain, sell and convey unto the said James H Stribling County Treasurer as aforesaid and his successors in office the following Lands situate in said County of Scott to wit: The west half of the South west quarter of Section twenty four and of township seven and of Range Seven E, together with all the privileges and appurtenances to the said land in any wise belonging or appertaining, to have and to hold the said land to the only proper use and benefit of the said party of the second part. Provided, nevertheless, that if the said T.M. Petty his heirs or Administrators, shall pay to the said James H Stribling County Treasurer as aforesaid or his successors in office, the said sum of One hundred dollars with interest thereon at ten per cent, per annum from date on or before the first day of January AD 1862 (twelve months after date) then this Indenture to be void otherwise to remain in full force and effect.
