Last Will and Testament of A.C.N. Sheley. deceased: In the name of God amen. I A.C.N. Sheley of the County of Tallahatchie and State of Mississippi being of sound mind, memory and understanding do make publish and declare this my last will and testament in the form following {to Wit;} I give my body to the dust, and my soul to God who gave it. My property an worldly estate, I dispose of as follows, Item 1st. I give to my wife the plantation a farm we now live on and described on the record as the SE 1/4 of the N.W 1/4 and the N.E 1/4 of SW 1/4 and two acres off of the N.W cannon of the N.W 1/4 quarter of the SE 1/4 all in section 14 Township 25. Range Three East together with all the stock farming implements, etc. belonging thereunto to have and to hold during her lifetime, provided, however that she not marry again. But should she marry then her rite and title to said plantation a farm and all stock and said farming implements, shall cease, except the rite to two horses of her of her choice, and the cattle and hogs, and my black buggy, and at her death or in the event that she marries again it is my will and desire that said plantation a farm, with all stock, wagons, farming implements, to be taken possession of by my executor, and sold as may deem best in their judgment, and the proceeds after paying all expenses of sale I desire to be equally divided between all of the heirs herein after mentioned except to my brother Robert B. Sheley (to-wit) Sidney J. Sheley and Nancy L. Sheley. Item 2-I give to my sister Lucy B. Tatum, fifty three and one third acres of land off of the South end of the SE 1/4 of section seven Township, Twenty four. of Range two East-Ranging square across said quarter section East & West. Item 3-I give to my Brother James M. Sheley, fifty three and one third acres of land off of the SE 1/4 of section seven Township Twenty Four of Range two East, Ranging square across the middle of said quarter section East & West, and more particularly described as the fifty three acres lying directly North of the land describes for Lucy B. Tatum, and joining the land now owned by said James M. Sheley, in said location seven. Item 4- I give to Sidney J. Sheley and Nannie L. Sheley, heirs of my brother Robert B. Sheley the following land (to-wit) the SW 1/4 of the SE 1/4 of section six Township twenty Four of Range Two East. Item 5- I give to my brother William W. Sheley the following, section of land (to-wit) the N.W 1/4 of the SE 1/4 of section six Township Twenty four of Range five East. Item 6- I give to my brother Franklin P. Sheley the following land (to- wit) the N.W 1/4 of the E 1/4 less four & one half acres, off the North boundaries and six acres off the West boundary of the N.E 1/4 of the SE 1/4 of section Twenty one Township Twenty five of Range two East. It being the land purchased by me of W.B. Marshall, as the record will show. I also give to the said Franklin P. Sheley my gold watch to have and to keep as his property; with this request that when his son William arrives at the age of twenty one years old, that he give him the watch as a present from me. Item 7- I give to my two Step-grand children (to-wit;) Lula L. McCarty and Laura M. McCarty, the following land (to- wit;) N.E 1/4 of section Twenty Eight Township, Twenty Five of Range two East and known as the land purchase by me of W.H. Fitzgerald as will also appear on the records, all of the above tracts as parcels of land, lying and being situated in the County of Tallahatchie and State of Mississippi- I hereby appoint my friends Richard Denman and John T. Neely, of said state and county, Executors of this my last will and testament, and it is my will and wish that my Executors shall not be required to give or make any bond in this matter. McAfee, who made oath according to Law in such case made and provided that the entire substance herewith presented and proporting to be the last will and testament, of A.C.N. Sheley, deceased bearing date August 30th A.D. 1887. Was signed sealed and published by said testator in the presence of affiants as the day of the date thereof. As his last will and testament, and that said affiants, signed the same as the witnesses thereto in the presence of said testator, and at his request; affiants further make oath that said testator was at the time of the Execution of said last will and testament of sound and disposing mind and memory and more than Twenty one years of age, Given to and Subscribed} H.H.
