Col. Harvey Statons Will The last will and Testament of my Harvey Staton Staton of Tallahatchie County Misp,,(he meant Mississippi). Item 1st. I direct that all my just debts and funeral expenses shall be paid as soon as the same can be done without sacrifice of my Property. Item 2nd. After the payment of all my just debts and the expenses attending my Estate I wish the balance of my Estate both real and personal to be Equally divided between my two sons, Arthur and Levi. Item 3rd. I wish my store in the Town of Charleston to be kept open and the goods sold as if I were living in the name of my executor & Son Arthur until 25th December next when I wish the Remnants sold out and the Business closed provided if my Executor Should think proper to do so he is hereby authorized to close the said store at any time during the year & sell the goods. Item 4th. I hereby nominate and appoint my Son Arthur Executor of this my last will and Testament and he shall not be Requested to give any Bond or the discharge of his duties as Executor unless the Probate Judge Shall believe the same should be done or the protection of my Creditors or my other Son the younger Brother of my Executor. Item 5th. I leave behind me only two children. Both Sons and under the age of Twenty One years and I do Enjoy them to live like brothers Should do and to love assist and protect Each other through life. In the matter of a Certain Instrument of writing purporting to be the last will and Testament of Harvey Staton deceased. Be it remembered that at a term of the Probate Court of the County of Tallahatchie County in the State aforesaid began & held at the Court House in and for said county on the Second Monday in May AD (1859)Eighteen Hundred and Fifty Nine. Personally appeared in open court James W. Rhew, W.A. Davidson, & John W. Montgomery. Subscribing witnesses to a certain Instrument of writing purporting to be the last will and testament of Harvey Staton deceased late of said county Bearing date the 4th day of May 1859 who having first been duly sworn deposes and said that said Harvey Staton Singed sealed and (delivered)published and declared said instrument as his last will and testament in the presence of those deponents on the day of the date thereof that said Testator was then of Sound disposing mind and memory & more than twenty years of age and that these deponent Subscribed Said Instrument as witnesses thereto at the Instance and request & in the presence of said Testator and also in the presence of Each other on t he day and year aforesaid Jas.
