Last Will and Testament of W.W. Sheley I W.W. Sheley of Charleston, Tallahatchie County, Mississippi, being of sound and disposing mind and memory, do hereby make, declare and publish this my last will and testament, that is to say: At my death I Will, bequeath and dispose of all my estate and property, both real and person as follows: ITEM NO: 1 My executor shall take charge of all my estate and property and out of the money coming into his hands shall pay any just debts that I may owe and the expense of my last illness, and shall manage said estate and hold the same intact until my youngest child shall be of full age except as hereinafter provided. ITEM NO: 2 My homestead in Charleston shall be subject to the use and control of my daughter, Mary, during her minority, free from any rent charges, but the barn and outhouses shall be used as heretofore for the convenience and benefit of the farm. ITEM NO: 3 My executor shall provide as hereinafter stated, for the support of my two minor children during their minority, and shall charge the same to my estate. ITEM NO: 4 My executor shall attend to the management and control of my estate and property and shall hold the real estate intact until my youngest child shall be Twenty one years of age, when the same shall pass and vest in equal parts in my four children, to-wit: Mrs. Ella Gowings, Mrs. Euta Darby, Riley and Mary Sheley. My said executor shall ascertain the amount due me by my children, and each of them, advanced since January 1, 1907, as shown by my books of account or otherwise, and shall charge the same to them and deduct such amounts from the pro rata share of each when making distribution of moneys as hereinafter provided. ITEM NO: 5 The money coming into the hands of my executor under this will shall be used by him in the conduct of said estate or distributed to my said children in equal parts as he may deem to be for the best interest of themselves and of said estate and he is hereby authorized to make distribution of all such money, including the income from said estate, from time to time, as in his judgment may reasonably be done without affecting such funds as he may reserve to pay current expenses, and at the end of the first c crop after my youngest child shall become of full age shall distribute to my said children the balance of the money remaining in his hands. ITEM NO: 6: My policy of benefit certificate in the Knights of Honor, payable to my deceased wife, shall be collected by my executor and paid out by him as other moneys coming into his hands, and if the collection o same shall necessitate the appointment of a guardian to my minor children, it is my desire that such guardian shall at once pay over to my executor such money as may come into his hands and that the guardianship be discontinued and a said minors support be executed as provided herein. I hereby nominate and appoint my friend, William Quarles, Jr. The executor of this my will, who shall execute the same without bond, and to whose accounts no mere technical objection or exception shall be taken, and who shall in no wise be held accountable for errors of judgment but shall take distribute and dispose of the money and property doming into his hands according to his best judgment, having regard alone to me wishes as expressed herein. I further will and direct that no guardian shall be appointed for my two minor children except as provided in Item No. 6 above, but that they shall be supported out of the income of my estate in such manner as my executor shall direct, and money or property applied to there use shall be deemed to be fully accounted for when receipted for by them. I commend to my children the religion of Christ as revealed in the Bible and that they contend not, the one with the other, but that their manner of life toward each other and toward the world shall make for peace and that they shall give to my executor full faith and confidence, considering always that he is selected by me on account of my faith in his integrity; and to him I commend the charge of my estate believing that in its administration he will keep before him those principals of justice and of honor that I believe have controlled his life and formed his character. The personal property belonging to my estate, other than the money may be used as my executor may direct or he may sell the same, if in his judgment it shall not be needed in the operation of the farm, and all such property shall remain unsold at the dates of final distribution of moneys provided above to be made, shall be divided equally among my said children.
