The seventeenth day of February in the year of our Lord one thousand eight hundred and eighty-three. I James Hargis of Tate County State of Misssissippi Farmer, being through the blessings of God of sound mind and memory, but calling to mind the frail tenure of life, do make qnd ordain this my last will and testament; that is to say. First - I give and bequeath - to my beloved son William Iverson Hargis my parent homestead consisting of NorthWest quarter of section 35 Township 5 Range 5 West, also all my personal property and monies. My beloved nice Parthenia E Jones to be supported out of it, by my son (William Iverson Hargis) during her natural life or maidenhood. To him my son William Iverson Hargis and his heirs and assigns forever. I also give and bequeath - to my beloved grandchildren Mary Ann Elizabeth Hataway (wife of G.W. Hataway) and John Davis Hargis, Ten Dollars each in United States currency; also the following described lands (xxxxx); (East 3/4 of SE1/4 crossed out)North half of North East quarter and East 3/4 of SE 1/4 being in all one Hundred and ten acres, All of the above described lands being and lying in the County of Tate and State of Mississippi. The lands bequeathed to my grandchildren Mary Ann Elizabeth Hataway and John Davis Hargis to be equally divided equally between them after my dimise. I also empower my son William Iverson Hargis to collec - all notes and accounts due me. I also appoint my beloved son William Iverson Hargis executor of this my last will and testament-without bond, hereby revoking all former will made by me. In witness whereof I have hereunto set my hand seal the seventeenth day of February one thousand eight-hundred and eighty-three. (sig) M W Brown (seal) (sig) W Z Walton (seal) State of Mississippi} Tate County } This the 3rd day of Sept 1883 being (Rules) day personally appeared before me clerk of the chancery court for said County, W Z Walton who upon oath-testifies that he saw James Hargis deceased sign the above named will and that he was of sound mind and did publish and declare that the above instrument of writing was his will, and at his request signed the sames as subscribing witnesses. And that we all signed it in the presence of each other, both testator and witnesses. (sig) W Z Walton Sworn to as subscriber before me this the 3rd day of Sept 1883 (sig) D C Holland Clerk In the matter of a certain instrument of writing purporting to be the Last Will and Testament of James Hargis dec'd} Be it Remembered that on this 31st of October AD 1883 the said being a day of the reqular October Term of the Chancery Court of Tate County Missippi personally came into open court, W Z Walton one of the subscribing witnesses to a certain instrument of writing purporting to be the Last Will and Testament of James Hargis Late of citizen of said county of Tate and now deceased and said W Z Walton being first duly sworn deposed & sayeth that the said James Hargis deceased was a citizen of Tate County and was at the date of the signing of said instrument of writing more than twenty one years of age and of sound departing mind & memory that the daid James Hargis on the day of the date of said instrument of writing to wit on the 17th day of February AD 1883 signed sealed published and declared the said instrument of writing as and for his Last Will and Testament in the presence of the said defendant and of M W Brown the other subscribing witness there to and the the said defendent and the said M W Brown signed the said instrument of writing on the day of the date there of as witness at the request of said testator and in his presence and also in the presence of Each other and that said testator departed this life August 5th 1883.
