Item 3 - to daughter Permelia S. Dudley - during her natural life then to her children, and to son William Crawford equally, tract of land where I live, Yalobusha Township 23 R 5 East and known as S.W. 1/2 of Section 29, and the North 1/2 of Section 32, with all improvements and appurtenances, plus stock on and of the farm - mules, horses, oxen, cattle, hogs, all household and kitchen furniture, to be equally divided, predicated on conditions hereafter named Item 4 - to Permelia during natural life and then to her children the following slaves - Elizabeth (known as Cook) and her children Eddy, Anderson and Ada, Als Bob, Stanford and Margaret Melinda and Mary a yellow woman, predicated on conditions hereafter named Item 5 - to William, the following slaves - Emaline (sperior? house servant) and her two children Johnny and Oscar, also Livinea, Jeff, Amanda, Milton, Big Sam, Nancy, Annett and David Item 6 - balance of slaves - Gia, Little Sam, Jane and her child Helen Wash, Allen, Elvina, Josephine Willis & Lucy Rome, also my Railroad stock both in the Miss. Central and Miss. and Tennessee to son Walter Scott during his life then to his children, predicated on conditions hereafter named Item 7 - Watch and lots in Grenada lying in East ward at feet of stores of Ingram and Land, Henderson Isley, and the two Parker lots extending each 104 1/2 feet to street running in front of John W Jones livery stable to son William the lots by and East of said street, I have heretofore given to son Walter Scott verbally now bequeath to him all titles I have in them Item 8 - Conditions previously alluded to as follows - if Permelia should die without issue living at her death, said (slaves?) to revert back to and vest in my children surviving her, or in the issue of such children as may have died, the issue to take the share or part which the parent would have had Item 9 - Conditions on bequest of slaves to Walter Scott - if he dies without issue, they revert to and vest in my surviving children Item 10 - In consideration that the legacies bequeathed to Permelia and William are of more value than that to Walter Scott, two years after my death Permelia and William each to pay Walter $500 Item 11 - All bonds and notes due me as well as the insurance due on my life for $5000 and the cotton growing or on hand at my death, revenues from this or as much as is needed to be used to pay my debts and residue to be equally divided between my children. Also the corn fodder and all the plantation supplies on hand or growing to remain for use of Permelia and William, and Walter not to take possession of the slaves till the expiration of the year in which I die but shall be entitled to hire from said death to said expiration to be paid by Permelia and William Item 12 - Appoints son Walter Scott and daughter Permelia S. Dudley as Exr and Exx who shall not be required to give security. The above and foregoing are my will and hearts desire maturely considered... written by myself in my own hand and seal this twenty third day of June in the year of our Lord one thousand eight hundred and sixty Signed Augustin Davis Statham Codicil to my will dated 29th day of June 1862 to which this is appended I loan to Permelia S. the following slaves of which I have become possessed since date of will - Old Tom Sidney, Andrew, Eliza, Jenett and child Willie Lucy Albert Ella and Minty Evaline Ruben Polly and Rose, the loan to continue for fifty years after my demise unless Permelia should die, then to the lawful heirs of her body, and if none, then the following slaves to Crawford - Old Tom Sidney Andrew Eliza Jenett Polly Rose and Willie; and the following slaves to Walter S. - Lucy Albert Ellen Menty Eveline and Ruben and if the slaves so vest in my sons, my will is that each of my sons shall pay hire thereof to Byron J Dudley on the first day of January each year to the rate of 40%. Fisher and Barnett Statham. Additional Comments: Barnett Statham was Augustin's older brother. Augustin's son Col. Walter Scott Statham died at Vicksburg, Mississippi about 16 days after his father's death. The life insurance policy referenced by Augustin was apparently the subject of a US Supreme Court case decided on 24 Oct 1876, "New York life insurance vs. William Statham and Permelia, et al., formerly Statham, appeal from the circuit court of the US, for the southern district of Mississippi" [published in the 24 Oct 1876 Memphis Daily Appeal].
