In the action started this afternoon the Boston & MOntana Consolidated Copper and Silver Mining Company asserts that the Montana Ore Purchasing Company,the Johnston Mining Company,F.Augustus Heinze,John MacGinnis and J.H.Trerise entered the veins and ore bodies of that portion of the Johnston Lode mining claim owned by the plaintiff and extracted,by means of underground workings,ore to the value of $3,800,000 and converted it to their own use.The contention is supported by an enumeration of th eveins lying within the walls of the claim that have been entered by the defendants. This suit is the seventh filed by the Amalgamated interest against the Heinze people in the past two weeks.
