S. P. Wilson & J. J. Matthews Admns., Of J. F. Matthews deceased; Against K. M. Matthews, who intermarried with S. P. Wilson, E. O. Matthews who intermarried with J. L. Spoon, J. C. Matthews, J. E. Matthews of full age & Bertha S. Matthews, Mattie V. Matthews & D. S. Matthews, infants, under twenty one years of age & without general or testamentary guardian, heirs at law of J. F. Matthews deceased; Petition to sell land for assets. I, J. I. White, Clerk of the Superior Court of Alamance County; The petition of S. P. Wilson & J. J. Matthews, administrators of J. F. Matthews deceased, respectfully showeth that they were appointed administrators of said intestate, by the clerk of the Superior Court of said county, on the 17th day of Oct. 1892, and, at once entered upon the administration of said estate; Your petitioners further show: (1)That from the best information and knowledge, which they have been able to obtain, the outstanding debts of the said estate amount to about $800.00. (2)That the value of the personal estate of said intestate was about $1400.00, the proceeds of which to the amount of $1211.31 have been applied to the discharge of the debts of said intestate, & the balance of such goods is still unused, but when disposed of will be applied as the other has been. (3)That at the time of his death, the said intestate was seized in full simple of the following lands, to wit; a lot or parcel of land situate in the town of Burlington, Alamance County, North Carolina, adjoining the lots of Anderson & Long, Frank Hay & others, bounded & described as follows, beginning at a stake on Davis Street, in said town, Frank Hays corner, thence with said street 25 7/8 feet to Anderson & Long’s corner, thence with line of said Anderson & Long, running back from said street 54 ¼ feet to a stake, thence 25 7/8 feet to a stake Frank Hay’s corner; thence with his, Frank Hay’s line 54 ¼ feet to the beginning, it being a parallelogram, and fronting 25 7/8 feet on said Davis street, between the lots of Anderson & Long & Frank Hay, running back 54 ¼ feet, and containing 1404 square feet, more or less – Valued at $1000.00. (4)That the said decedent left him surviving the following named heirs at law, to wit, K. M. Matthews who intermarried with S. P. Wilson, E. O. Matthews, who intermarried with J. M. Spoon, J. C. Matthews, & J. E. Matthews all of full age – and J. J. Matthews, of full age, and Bertha S. Matthews, Mattie V. Matthews & David S. Matthews infants under twenty one years of age, all of said parties residing in the county of Alamance & State of North Carolina. (5)That a sale of said lands is necessary to pay the debts of said intestate & the charges of Administration. Wherefore your petitioners pray: (1)That a decree may be made by this court for the sale of said lands and such terms as the court may direct. (2) That a commissioner may be appointed to sell said lands under the direction of the court. Chas. E. McLean, Attorney for the petitioners. S. P.
