ALAMANCE COUNTY, NC - COURT - #9738 George W. Swepson & Rufus V. McAden Vs Joshua Rouse & Wife --------------¤¤¤¤¤¤-------------- Supreme Court Case found at the NC Archives Alamance County 1871 Case originally file Fall Term 1864 in Alamance County Joshua Rouse pretending to be seized of a tract in Lenoir Co where Joshua then lived adj to lands of William L. Phillips and the heirs of Lewis Whitfield - 550 acres - said Rouse agreed to sell the land for $15,000 - 1/2 of which was immediately paid and the other half to be paid as soon as a good title was obtained - Rouse issued his obligation on 13 August 1863 - Rouse has failed to provide the title - plfs want the title JOSHUA ROUSE'S ANSWER His wife was Ann Eliza Rouse - Joshua admitted to the Bond and the sale of the land -the 1/2 paid was paid in Confederate Treasury Notes - Joshua stated where he lived was debatable ground between the two armies and he suffered along with others - in 1863 he lost a greater portion of his labor??? And he became quite dispirited - the buyers came from Alamance Co and offered to buy the land - the def told them his wife owned 1/2 of the land in her own right and she would have to consent - Joshua and his wife wished to move from Lenoir Co to somewhere quieter - Joshua was a simple farmer and didn't know how much Confederate money was worth or how it would help them buy another place - plfs assured him that Confederate money would work fine - his wife Ann Eliza would not sell unless the money could be used to buy another place and she would not take Confederate money - Joshua in his ignorance took 1/2 of the money and then found out it was worthless and what he got was only worth about $500 - he tried to find another county to live in and no one would take Confederate money - his wife refused to sell -Joshua wrote the plf and explained and said he would return the Confederate money, with interest - Joshua stated a public road ran through the property from Hookerton to Bell's Bridge - all of the land NS of the road belonged to his wife being land conveyed to her by John H. Daniel Jr in 1856 - the land SS of the road belonged to Joshua - Joshua stated he had filed Bankruptcy in Pamlico District in 1868 and all the debts he had before that time were eliminated. The local Court found for the plt and Joshua Rouse appealed to the Supreme Court and they reversed the decision based on his bankruptcy. ___________________________________________________________________ Copyright.
