All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Mary Maarbjerg http://www.genrecords.net/emailregistry/vols/00026.html#0006256 November 6, 2008, 4:57 pm Written: 1721 Various Land Transactions - 1720-1721 John & Mary Bush Chowan Precinct, Albemarle County mpm transcription Chowan County Registrar's Office Book F1 Pg 158-162 Deed - John Bush to Edward Bryan - 15 July 1721 This Indenture made this fifteenth day of July in the year of our Lord one thousand seven hundred & Twenty one, Between John Bush of the precinct of Chowan the County of Albemarle & province of North Carolina of the one part & Edward Bryan of the precinct & County aforesaid of the other part. - Wittnesseth, that the said John Bush for the valuable consideration of five pounds Lawfull money of England to him in hand paid by the aforesaid Edward Bryan the receipt whereof the said John Bush doth own himself fully satisfied & paid by the aforesaid Edward Bryan the receipt whereof the said John Bush doth hereby acknowledge & of every part & parcel thereof doth acquitt exonerate & discharge the said Edward Bryan his heirs, Exors, admrs, & assigns forever have given granted bargained & sold & by these presents doo fully clearly & absolutely give grant bargain & sell part of a tract of Land lying in Chowan precinct aforesaid in the west side of Barbicue, containing two hundred & sixty acres beginning at the mouth of Bryary Branch & soe up the barbicue to a concluded line beginning at a chinkapin & soe up the head line & soe down the head line to Francis Macklendins line & then along his line south to a line or live oak in the bryary Branch then down the Branch to the first station. To have and to hold, the said Land bargained & sold as aforesaid unto the said Edward Bryan his Heirs & assigns forever with all the rights members & appurtenances thereof forever with all woods waters & water courses & all other liberties & priviledges thereon contains & the said John Bush doth warrant it from him his Heirs, Exors admrs or assigns & doth promise & warrant at the ensealing and delivery of these presents that he hath a good right title Estate in the premises in fee simple & hath fully right & lawfull authority to bargain & sell the same unto the said Edward Bryan his heirs & assigns forever & by these presents warrant the said premises bargained & sold as aforesaid to be & remain free from all claim & demand of the John Bush his heirs Exors admrs or assigns or any other person or persons whatsoever laying claime to any part of parcel thereof. And that the said Land & premises now are & shall forever year after remaine continue & be unto the said Edward his heirs & assigns forever free & freely acquitted exonerated & discharged of and from all manner of former & their gifts, grants, leases, uses, Titles, wills, annuances, rents, & arrearage of rents & all other Incumbrances of what nature & kind soever. & that the said Edward Bryant his Heirs & assigns shall from time to time & at all times hereafter have hold occupy possess and enjoy the said Land & premises without the Lett suite trouble denyale molestation Interuption or eviction of the said John Bush his Heirs Exors admrs or assigns or any other person or persons whatsoever laying lawfull claim thereunto or any part or parcelle thereof & for the Full performance of every article & claim as is above expresses & for the acknowledging the same unto the said Edward Bryant his heirs heirs [sic] Exors admrs or assigns when thereunto reasonably required, the said John Bush binds himself his Heirs Exors & admrs in the penale sum of Twenty pounds lawfull money of England. In witness whereof he the said John Bush hath hereunto sett his hand & fixed his seal. John Bush (Seal) Signed, sealed & delivered in the presence of us John Bryan Tho (T) Macklendin Att a Court held for Chowan precinct at the Court House in Edenton on Queen Annes Street (?) the 18th day of July 1721. John Bush came into Court & acknowledged his Deed for Land to Edward Bryant & John Falconer by virtue of a Power of Attorney from Mary Bush acknowledged her right of Dower in & to the said Land, which on motion is ordered to be recorded & is recorded.
