Albemarle County, NC - Deed - Charles Wilks to John Rice, 1728 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Perquimans Precinct, Albemarle County Book B, Number 297 This Indenture made the 8th day of April in the first year of the Reign of our Sovereign Lord George by the Grace of God King of Great Britain France & Ireland &c Anno quo Dom 1728 – Between Charles Wilks of the County of Albemarle & Precinct of Perquimans in North Carolina of the one part and John Rice of the county aforesaid Precinct of Chowan of the other part Witnesseth that the said Chal Wilks for the Valuable Consideration of Twenty Pounds Sterling Money of Great Britain to him in hand paid by the aforesaid John Rice the Receipt whereof he the said Charles Wilks doth by these Presents Acknowledge and for himself his Heirs Executors Admrs & Assigns Doth Hereby likewise acquit Exonerate & Discharge him the said John Rice his Heirs & Assigns forever --- Have Given Granted Bargained & Sold & by these Presents Doth fully Clearly & Absolutely Give Grant Bargain Alien Sell & forever make over & confirm unto him the said John Rice his heirs & assigns one hundred & fifty Acres of land situate Lying & being in Perquimans Precinct near the South Side of a Swamp commonly known by the name of Warrick Swamp, Beginning at a pine Standing in Martin Aspell line & from then So. Wardly by a line of marked Trees & Round a pond commonly known by the name of the Cypress pond to a pine & from thence Westerly by A line of Marked Trees to a pine Nathn. Williams Corner Tree & from thence along his line No. ardly to the line of the aforesaid Marten Asspell & then along his line Eastardly to the first Station. Be it one hundred & fifty Acres more or less, the Said Land being part of a Patent Granted to Thomas Blitchenden for the aforesaid quantity of five hundred and 28 Acres as by A Patent Bearing date the 14th Day of July 1725 Doth & May Appear And by the said Thomas Blitchenden Sold & conveyed to Charles Wilks Party to these Presents as by a Deed of Sale under the Said Blitchendens hand & Seal now upon record relation thereunto being had Doth and may fully & at large appear, To Have & to Hold unto the Said John Rice his Heirs & Assigns with all the Rights members & Appurtenances thereof With all Houses Orchards Clear Grounds & Wood land Ground with all Woods Waters Trees & Timber Trees Meadows & Meadow Ground Low Grounds Swamps Marshes Springs & fountains and all other liberties & Priviledges therein & thereon Contained & the Said Charles Wilks for himself his heirs Executors Admrs. Do by these Presents Promise & Warrant at the ensealing & Delivery Hereof that they Have a good Right & Title in fee Simple of the Premises aforesaid & hath fully right & lawfull authority to Bargain & Sell the Same unto the said John Rice his Heirs & Assigns forever, And that the said Land & Premises with all & singular its appurtenances now on & So Shall & May forever Hereafter Remain Continue & be unto the Said John Rice his heirs & Assigns free & freely clear & clearly Acquitted Exonerated & Discharged of & from all & all Manner of Gifts Grants Leases Sales Morgages Deeds Wills Bonds Judgments forfeitures, rents & avarages of Rents and all other Incumbrances of What nature or kind Soever But that the said John Rice his Heirs & Assigns Shall & May from time to time and at all times Hereafter Peacably & quietly Have Hold Occupy Possess & enjoy the aforesaid land & Premises with all & Singular its appurtenances without any of the lawfull let suit trouble Denial Disturbance molestation Interruption Eviction of him the Said Charles Wilks his heirs or assigns or any other Person or Persons claiming by from or under him or them or any of them or any other Person or Persons Whatsoever that Shall or may lay any manner of lawfull claim thereunto or any part or parcell thereof --And the Said Charles Wilks for himself his Heirs Executors Admrs Do by these Presents Covenant & agree to & with the sd John Rice his Heirs & Assigns to make any further or other act Conveyance or Devices at any time or times within Seven years next Ensuing the date Hereof at the Reasonable request of him the said John Rice his heirs or assigns or their or either of their Learned Councell in the law Shall Devise or advise for the further & better assuring & Sure making the aforesaid Land & Premises with all & singular its appurtenances unto the Said John Rice his Heirs & Assigns forever.
