Contributor's Note: This is a transcription of an original deed in my possession (not a copy.) It was found in the possessions of Maggie Bowen Stone Childress (d. 1983), my husband's paternal grandmother, at her decease. I am uncertain of her connection to any of the persons named in the deed, or how it came to be in her possession. This deed is in extremely poor condition. The single sheet, yellowed and blotchy with parts of the writing bleeding through to the opposite side, was originally folded six ways, and has at some point in the past fallen apart and been taped back together. The writing is still quite legible. I have tried to transcribe this document exactly, including the formatting, spelling and capitalization as they are found in the original. Only the page numbers in parentheses have been inserted by me. (Page 1) State of North Carolina} Court of Pleas & quarter Sessions Alexander County } March Term 1863 I R.P. Matheson Clerk do hereby certify that the within deed was presented in open Court and the due execution thereof was duly proven by the oath of J.A. James Deed To Micager Fortner 100 Acres of Land ======================== (Page 2) This indenture witnesseth that James James of the county of Alexander and State of North Caolina in consideration of the Sum of two Hundred and ten Dollars to him paid by Micager Fortner do Sell to the Said Fortner his heirs and assignes a certain peace or parcel of Land in said county on the waters of Lower Little River containing one hundred acres more or less Bounded as follows Beginning on a pine in James~ line thence East 90 poles to a pine in Peter Barnes~ line thence South with said line 180 poles to a post oak thence west 90 poles to a post oak saplin thence North 180 poles to the Beginning Granted by the State to Neeleen Phillips No 2467 (2461?) And I the said James do covenant with the said Fortner as follows 1st that he is lawfully seized of the said land 2nd that I have a good right to convey same 3rd that the Same is free from encumbrances 4th that the said Fortner his heirs & assignes shall quietly enjoy the same 5th & lastly that I will warrant & forever defend this tittle to the said Fortner his heirs & assignes against the claimes of me my heirs and all other person whatsoever claiming under me in testament whereof I have hereunto Set my hand and Seal this 28th day of September 1853 Signed Seald & delivered in presants of Attest} Wm G James J.A.
