ALLEGHANY COUNTY, NC - WILLS AND ESTATES - Daniel Crouse Probate File ----¤¤¤¤---- PART 1 of Daniel Crouse probate file. This file is in 2 places in the NC Archives. One portion is filed under Crouse and the other under Krows. Transcribed by Carolyn Spence. Daniel Crouse estate - a 2nd file found in the archives files. This is the same Daniel Crouse estate that John Crouse & Alfred Moxley were appointed Administrators of in 1866. Berry Edwards vs. Elizabeth Crouse, widow and Executrix of Daniel Crouse: filed Spring term 1866: Berry stated that he loaned Daniel Crouse $149.66 on 4 March 1859 and that Daniel paid him $ 100.00 on 22 March 1860 and that a balance of $ 68.00 including interest was still due when Daniel Crouse departed this life about one year ago. He stated that Daniel Crouse made & published a Last Will & Testament thereby disposing of a lot of cattle, hogs, one horse, household & kitchen furniture and many articles including the land. He stated that he was informed that by the Will all of the above was bequeathed to Daniel's wife Elizabeth and since the death of husband she has been in the exclusive posession and enjoyments of all of the said property and until this time defendant has wholly refused and neglected to offer the said Will of her husband for probate in the proper court and still refuses to do so, so that the estate can be properly administered. He further stated that the defendant has been selling off the property and is now offering the entire estate for sale and is preparing to leave the state of NC with all her effects and her husband's effects and remove to the State of Iowa. He asks that she be restrained from leaving NC and immediately produce Daniel Crouse's Will to probate court.Complaint was accompanied by a statement from David Edwards that it was true, on 20 March 1866. The next day a warrant for arrest was issued for Elizabeth to post bond, not leave Alleghany County or the State of NC. She appeared before the Sheriff and her bond was posted by Wm. J. Joines in the amount of $200.00 on 24 March 1866 and ordered to appear at the next court to be held at Shiloh Church. Berry Edwards also had to post a $100.00 bond to the court and his bondsmen were D. Edwards and George Reeves. A bond dated 23 April 1866 was offered up by John Crouse & Alfred Moxley in the amount of $1500.00 and they jointly were appointed Administrators of the Daniel Crouse estate. Their bondsman were Wm. H. Joines and Isom Waggoner. Isom offered an accounting of the Guardian account for the children in the Jan. term of 1865 which should have been with another file. I will have to check on this piece of paper because it states "Received of Administrator Daniel Crouse" Loaned Morgan Bryan $101.00 on 28 Oct. 1861 and Isom Waggoner had collected $108.50. Loaned $100.00 to Ezekial Joines & Merida Cheek on 27 April 1863 and Isom had collected $103.00. Loaned $111.00 to Samuel H. Thompson on 27 Jan 1864.
