Fender to J.M. Gambill Know all men by these presents that W.A. Fender am held and firmly bound unto James Gambill in the sum of six hundred dollars for the payment of which I bind myself, heirs, executors, administators. Signed, sealed and delivered this 15th day of March 1895. the condition of the above obligation is such that whereas on the --- day of Sept 1890 James Gambill sold and contracted by title bond to convey to Charity Fender and Solomon Fender a certain boundary of land on the waters of Rock Creek ( for specific boundaries see deed from James Gambill to W.A.Fender of even date of this bond) and whereas the said Charity and Solomon Fender both died before the land was fully paid and deed made, and whereas I, W.A.Fender, have finished paying the purchase price on said land and have procured deeds from all the heirs at law of the said Solomon and Charity Fender except, Vick Fender and Jennie Fender, who are minors to their interest in and to the aforesaid land, and whereas I am desirous to have a deed in fee from James Gambill to said lands, and to indemnify him and secure him fully from any claims that the aforesaid minors Vick and Jennie Fender may set up hereafter. I execute to him this bond upon the delivery to me of the deed as aforesaid. Now therefore if the said Vick and Jennie Fender shall make or cause to be made a good deed to their interest in the said land when they arrive at the age of 21 years, or should they ever set up or offer claims for their interest if I save him the said Gambill harmless, then this obligation is to be void otherwise to remain in full force and effect in the law. W.A.Fender witnessed by W.E. Cox, 22 March 1895 Recorded 22 Feb 1897. Final report of Administrator: I hereby report that as Administrator of Solomon Fender, Sr., dec'd, nothing has come into my hands as funds belonging to the estate of my testator, neither in my opinion will there be anything to come into my hands in the future from said estate, as I filed he had no property at the time of his death. Respectfully submitted, C.J.Edwards, Administrator March 17,1899 Alleghany County NC
