ELLIOTT of the one part & THEOPHILUS HOPGOOD of the one part both of the County of Anson and State of North Carolina. Witnesseth that for and in consideration of the sum of Seventy dollars in hand paid by the said JOHN ELLIOTT the receipt whereof is hereby acknowledged Hath Granted Bargained and sold to the said ELLIOTT a certain tract of land on the waters of Beaver Dam Creek Anson County Beginning at a pine WARRICKS corner and running with his line So. 50 Wt. 120 poles to a stake by 3 post oaks, then So. 65 E. 160 poles to CUTHBERTSON'S corner post oak then with his line No. 65 E. 176 poles to a stake by two red oaks and a pine then No. 28 wt. 100 poles to a stake by 2 red oaks and a pine then No. 50 Wt. 135 poles then So. 30 Wt. 43 poles then to the Beginning containing Two hundred acres be the same more or less To have and to hold to him the said JOHN ELLIOTT his heirs Exc. & assigns forever and the said HOPGOOD doth by these presents warrant and forever defend the above named premises fair and clear from him his heirs Exc. and assigns and also from all manner of claims from any other person or persons. In witness whereas the said THEO. HOPGOOD hath here unto set his hand and Seal the day and date above written. The conditions of the above obligation is such that whereas that JOHN ELLIOTT becomes security of THEOPHILUS HOPGOOD in two judgments in favor of SMITH LINDSEY for the sum of Seventy dollars which the stay will be out in 1838. Now should the above named THEO. HOPGOOD pay the above named judgments or in any way settle the same then the above obligation is void otherwise to remain in full force and virtue day and date above written. TH. HOPGOOD Test.
