WITNESSETH that the sd. JOHN ELLIOTT is justly indebted to STEPHEN HASTY in the sum of One Hundred and Sixty Three Dollars and 21 cents bearing interest from the 1st instant due by judgment bearing date with this deed and the sd. JAMES MARSH having become security for the same the sd. ELLIOTT being desirous to pay the above named sum of money and to secure the sd. MARSH from the payment of any part thereof and in consideration of the further sum of Five Shillings the receipt whereof is hereby acknowledged has bargained sold and conveyed unto the said JAMES MARSH a certain piece or parcel of land whereon the sd. ELLIOTT now lives bounded as follows (Viz) beginning at sd. JOHN ELLIOTT'S North Western corner of PARKER'S line which was formerly a black jack by 3 pines and runs with the different lines dividing between the sd. ELLIOTT and the land whereon LEMUEL PARKER lives to WICKER'S Branch then down the various courses thereof to the mouth of Long Branch then up the various courses of Long Branch to an ash dividing the corner between the sd. ELLIOTT & WILLIAM ELLIOTTS heirs then due Et. to a stake on the old SHEPHERD line then with that line N. to the corner black oak then with the other line S. 75 W. to the beginning containing one hundred and fifty acres be the same more or less and I the sd. JOHN ELLIOTT warrant and defend sd. land & premises with all the appurtenances thereunto belonging from me my heirs and all lawful claimants unto these JAMES MARSH his heirs and assigns in trust with the powers as follows (Viz) if the sd. JOHN ELLIOTT does not fail to pay the above named sum of One Hundred & Sixty Three dollars and 21 cents and interest within twelve months from this date then sd. JAMES MARSH is hereby authorized and appointed my lawful trustee with full power to sell the above mentioned land on the premises by first giving notice thereof by advertisement at three public places one of which shall be at the Court house in Wadesboro twenty days before the sale to the highest bidder for ready money and out of the proceeds of sd. sale to retain the amount above mentioned & interest & sixty cents for recording this trust and reasonable pay for any trouble he may be at and if there should be any monies arising from sd sale after paying the sums before mentioned the sd JAMES MARSH shall pay over without delay such surplus so remaining in his hand to the sd. JOHN ELLIOTT or his lawful representatives provided nevertheless if the sd. ELLIOTT shall well & truly pay the sums above mentioned by the time specified or otherwise arrange the same so as to discharge sd. JAMES MARSH from sd. securityship then this deed to be null and void otherwise to remain in full force and virtue. Signed sealed and delivered in the presence of G.W.
