The second time, in 1885, RUSSELL ROGERS makes oath that he knew John Elliott and could identify his handwriting as that of the John Elliott in the deed below, written in 1824. The deed apparently went unregistered until brought forward in 1885. STATE OF NORTH CAROLINA UNION COUNTY The foregoing (below) certificate Of J.G. TRULL, a Justice of the Peace of Union County is adjudged to be in due from and according to law; therefore let the foregoing deed, with these certificates be registered. HOOLFE Register This Indenture made this 30th day of March in the year of our Lord one thousand eight hundred and twenty four between JOHN ELIOTT of the County of Anson and State of North Carolina of the one part and NANCY TRULL of the County and State aforesaid of the other part witnesseth that the said ELLIOT for and in consideratiion of the sum of One Hundred and Fifty Dollars in hand paid by the hand of STEPHEN HASTY for said NANCY TRULL the receipt whereof I do hereby acknowledge hath bargained sold and conveyed unto the said NANCY TRULL a certain tract or parcel of land situate lying and being in the aforesaid County of Anson and bounded as follows (viz) Beginning at a post oak with three red oak pointed and runs East 29 chains to an ash in a branch thence No. 52 chains to a stake with stake in SOLOMON TRULL'S own line the So. seven West 53 chains to a stake then to the beginning containing one hundred and fifty acres be the same more or less together with all houses ways waters profits hereitaments and appurtances to the same belonging or in any wise appertaining and I the said JOHN ELLIOTT do hereby agree to warrant and forever defend all rights and titles of the aforesaid tract of land for myself my heirs and assigns forever free and clear from the lawful claims of all persons whatsoever unto said NANCY TRULL her heirs and assigns forever In witness hereof I the said JOHN ELIOTT have hereunto set my hand the day and date above written. Signed sealed and delivered in the presence of us JOHN ELLIOTT (seal) Witness MOSES PEARCE TEST: SALATHIEL PRESLAR STATE OF NORTH CAROLINA UNION COUNTY SUPERIOR COURT Be it remembered that on this 12 day of Nov. 1885 personnally appeared before me RUSSELL ROGERS who after being duly sworn deposes & says that he is acquainted with the handwriting of JOHN ELLIOTT the grantor of the foregoing deed & that the signature of said grantor to said deed is his own proper & genuine handwriting and that said grantor & MOSES PEARCE & SALATHIEL PRESLAR the two subscribing witnesses to said deed are dead. It is therefore adjudged that said deed is sufficiently proven.; Let the instrument with this certificate be registed this 12th day of Nov. 1885.
