ROGERS and MARTHA ROGERS of the district and state aforesaid heirs at Law of JOHN ROGERS deceased of the one part and BENJAMIN F. PEARSON and CLINTON PEARSON of the County of Anson and state of North Carolina of the other part. WITNESSETH that whereas HERBART PEARSON of the said County of Anson was indebted by Judgment in said County to one ROBERT ELLIOT of George Town, South Carolina and also to one ISAAC COURSE of Cheraw South Carolina and whereas said HERBART PEARSON did execute a Mortgage to the said ELLIOT and COURSE for certain lots of land in Sneedsboro in the said County of Anson also a tract of Land Containing two hundred acres near Sneedsboro aforesaid also some other tracts near Sneedsboro Containing eight & a half acres also for certain negroes mules horses household and Kitchen furniture stock of Hogs and Plantation utensils as will more fully appear by reference to the said Mortgage which was dated the 18th day of April A.D. 1806 and is recorded in the Registers office in the said County of Anson aforesaid which said Mortgage was so made to secure the payment of said debts above said and whereas it was agreed between the said HERBART PEARSON and the said JOHN ROGERS in his life time that the said JOHN ROGERS should purchase the said Lots of Land and other property contained in the said Mortgage and hold the same in trust until such monies as he advanced there for should be repaid to him and afterwards to hold the same in trust for the proper use and benefit of MARTHA A PEARSON wife of the said HERBART PEARSON now the said BENJAMIN F. and CLINTON PEARSON having fully settled and satisfied all the claims of the said JOHN ROGERS and his representatives for or on account of the monies so advanced by the said JOHN in his lifetime for the said Mortgage property in pursuance of the above agreement and also for and in consideration of the sum of Five dollars in hand paid by the said BENJAMIN f. PEARSON and CLINTON PEARSON to the said FRANCES L. LEE, his wife, CAROLINE, MARY POUNCY, SARAH J. ROGERS and MARTHA ROGERS all the heirs at Law of the said JOHN ROGERS Decd. who are of legal age now Know Yew that we the said FRANCES L. LEE and his wife CAROLINE, MARY POUNCY, SARAH J. ROGERS and MARTHA ROGERS heirs at Law as above for and in consideration of the premises above have bargained sold conveyed and set over unto the said BENJAMIN F. PEARSON and CLINTON PEARSON their heirs and assigns forever all their right title claim and interest which we have as trustees to the all and every part or portion of the said above mentioned property mortgaged as above to have and to hold the same in trust for the said MARTHA PEARSON her heirs and assigns forever as fully and absolutely as we the said heirs at Law of the said JOHN ROGERS deceased can of right do by Virtue of the above agreement and decree of the Court of Equity there being other minor heirs of said JOHN ROGERS, deceased and we the said FRANCES L. LEE, his wife CAROLINE, MARY POUNCY, SARAH J. ROGERS and MARTHA ROGERS for ourselves do hereby relinquish forever Quit claim and set over to the said BENJAMIN F. PEARSON and CLINTON PEARSON in trust aforesaid all the rights and title which we in any way have unto the said property against ourselves our heirs and against every other person who may claim by virtue of our right and no further. CRANCH UNITED STATES OF AMERICA DISTRICT OF COLUMBIA Be it remembered that this day 28th of February 1850 at the City of Washington in the said district before the subscriber one of the Judges of the Circuit Court of the United States for the said district being a Court of Superior Jurisdiction within the said district personally came the honourable JOHN MCQUEEN of South Carolina now a Member of the House of Representatives of the United States a subscribing witness to the annexed deed marked WC from FRANCES L. LEE, CAROLINE E. LEE, MARY POUNCY, SARAH J. ROGERS and MARTHA ROGERS TO BENJAMIN F. PEARSON and CLINTON PEARSON and upon his oath proved the due and Legal execution of the same by FRANCES L. LEE, CAROLINE E. LEE, MARY A. POUNCY, SARAH J. ROGERS and MARTHA L. ROGERS as their act and did for the purpose therein declared In Witness whereof I have hereunto set my hand the day and year aforesaid. W.
