BOGGAN SHFF TO PEARSON RICKETTS State of North Carolina To all Persons to whom these presents shall come George D Boggan high sheriff of the County of Anson in the State of North Carolina ...doth greeting whereas by a Writ of Fiari Facias issued out of the Court of Pleas and Quarter Session for the County of Anson bearing teste the second Monday of July AD 1847 last part and to the said sheriff directed he was commanded that of the real Estate of James Swanner deceased to his heirs descended if to be found in the County he should cause to be made the sum of Thirty three dollars 46 cents with interest which J.O.W Leah and others ...the said Court recovered for their debt and damages against the Estate of James Swanner deceased and which were then and there adjudged to the said JOW Leah and others for their debt and damages and also the further sum of Forty five dollars and forty cents which were then and there adjudged the said JOW Leah for their costs and charges by them in their said suit expended and whereof the said Estate was liable as appears of record and that he should have the said moneys before the said court on the 2nd Monday of October AD 1847 then next ensuing then and there to render to the said JOW Leah and others the said moneys for his said debt damages & costs and that he should have then and there that Writ and whereas also the said Sheriff did on that day return to the said court that by Virtue of the said writ to him directed he had served and taken in execution the said real Estate situate and lying and being in the County of Anson lying on the waters of Jones Creek adjoining George W Little Thomas Gaddy and others. Beginning at a stake Lewis corner and runs with said Lewsi line No 10 Wst 5 chns to a stake 1 pine 2 black jacks & 2 red oaks pointers then So 88 Wst 7 chns to a Pine then No 10 Wst 3 chns to a stake by 4 pines then west 22 chains 6 lks to a stake by 2 pines then So 2 Est 30 chns to a stake 1 pine black jack and gum pointers then No 80 Est 12 chns & 50 links to a stake then No 2 chns to a pine by a pine then So 82 Est 22 chns & 70 links to a stake in the branch 1 maple water oak and persimmon pts then down the various courses of said branch 32 chns 35 links to the mouth of Meeting House branch then up the various courses of the branch 44 chns & 40 links to a stake in said branch 1 pine 2 black gum pts then west 39 chns to the beginning. Containing 204 acres more of less And whereas the said Sheriff having having given due and legal notice of the time and place of said sale of said land did on the 16th day of October AD 1847 expose the sale by public voice or outcry and sold the same to Lydia Swanner for the sum of one hundred & ten dollars she being the highest bidder and that the highest and best price bidden for the same and the said Lydia Swanner transfers the same to Pearson Ricketts who paid the money Now Know Ye that the said Sheriff for and in consideration of the aforesaid sum of one hundred and ten dollars to him in hand paid by the said Pearson Ricketts at and before the unsealing and delivery of these presents the receipt whereof he doth hereby acknowledege hath given granted bargained and sold by these presents according to the directions of said recited writ and by force and virtue thereof doth give grant bargain and sell unto the said Pearson Ricketts his heirs and assigns all the said above described lands and tes,,,,,together with all and singular the buildings improvements rights members and appertinances whatsoever thereunto belonging or in any wise appertaining an the reversions and remanders rents leases and profits thereof and also .. the Estate right title interest or demand of the said heirs of James Swanner of in to or out of the same to have and to hold the said land ... hereditaments and premises hereby granted assigns to his and their only proper use and behalf forever for such estate and under said rents conditions and limitations as the said heirs of James Swanner had and held the ... And immediately before the taking thereof in execution but for no other and greater estate than the said heirs then and thee held the same accordingly to the form and affect of the laws and usages of the State of North Carolina in such cases made and provided In witness whereof the said Sheriff hath hereunto set his hand and affixed his seal this 16th day of October AD 1847, signed sealed and delivered in presence of AB Smith [Signed] Geo.
