From Thomas Hightower to John Cook THIS INDENTURE, Made this third day of August in the year of our Lord one thousand seven hundred and sixty seven Between Thomas Hightower late of the County of Anson Planter of the one part and John Cook of Anson County of the other part WITNESSETH that for and in consideration of the sum of fifteen pounds Procklamation Money to the said Thomas Hightower in hand paid by the said John Cook at and before the sealing and delivery of these presents the Receipt and payment whereof if hereby achowledged hath granted bargained sold aliened enfeoffed conveyed and confirmed and by these presents doth grant bargain sell alien enfeoff convey and confirm unto the said John Cook his Heirs and Assigns forever all that mesenges or tenements Plantation Tract or Parcel of land situate lying and being in Anson County and on the South side of Pee Dee River and on the fork of Brown Creek being part of the Tract or Parcel of land which the sd Cook Now lives on and is buttted and bounded as follow, to-wit: Beginning at East End of a new line of marked trees which divides the same from the lower part of the Tract of land granted to the said Thomas Hightower by the Kings letters Patent of which the Promises above mentioned are the upper part and which lower part of the said Tract has been conveyed to William Thomas thence south twenty degrees East two Hundred and Eighty poles to a pine thence south seventy degr. west two Hundred and twenty poles crossing the said Creek to a pine thence North Twenty Degr. west two Hundred and Eighty Poles to a pine on the south side of the said fork thence in a direct line to the weste end of the sid new line of marked tree 158 poles thence along the said new line of marked trees to the first mentioned station containing by estimation One Hundred acres of land be the same more or less with the apurtenances situate lying and being as aforesaid with theirs and every of theirs rights members and appurtenances whatsoever and the Reversion and Reversion Reminder and Remainders of all and sigular the said land tenements hereditaments and premises hereby granted or intended to be granted and of every part and parcel thereof and all rents issues services and profits to them or any of them or any part or parcel of them or any of them incident belonging or appurtaining and also all and every the Estate and Estates Rights titles claimes interests and demands whatsoever him the said Thomas Hightower in to or out of the said lands tenements hereditaments and premises whatsoever ren by grated or mentioned to be granded or any of them or any part or parcel thereof. TO HAVE AND TO HOLD the said lands tenements hereditaments and premises hereby granted with their appurtenance to the said John Cook his Heirs and Assigns to the only proper use and behoof of the said John Cook his Heirs and Assigns forever and the said Thomas Hightower for himself his Heirs Executors and Administrators doth hereby promise covenant and agree that he the said Thomas Hightower his Heirs Executors and Administrators shall and will at all times warrant and forever defend the said premises to the said John Cook his Heirs and Assigns against all lawfull claims or demands whatsoever whereby the above mentioned promises might or may be affected or incumbred contrary to the true intent and meaning of these presents Page 153 [page title] From October Term to January Term 1768 IN WITNESS WHEREOF the said Thomas Hightower has hereunto set his hand seal the day and year first above written.
