NC Deed Book 5 p. 51 Zachary Phillips to John Leverett NORTH CAROLINA. This Indenture made this 8th day of July in the year of our Lord Christ 1758, Between Zachary Phillips of Anson County in the province aforesaid, planter of the one part & John Leverett of the County & province aforesaid planter of the other part.. WITNESSETH that the s'd Zachary Phillips for & in consideration of the sum of forty pounds current money of Virginia to him in hand paid by the s'd John before the sealing & delivery of these presents the receipt whereof he the sd Zachary Phillips doth hereby confess & acknowledge himself to be therewith fully paid & satisfied & therefore hath granted bargained sold aliened & confirmed & by these presents doth grant bargain sell alien and confirm unto the said John Leveritt his heirs & assigns forever a tract of land granted to the s'd Zachery Phillips by his majesty's letter patent dated at Wilmington by his majesty's letter patent dated the July the 1st 1758, containing three hundred acres situate on the South side of Pee Dee river. Beginning at a hickory on the east side of the grindstone branch of Gould's fork & runs South 42 West 220 poles crossing the s'd branch to a pine then north 48 west 220 poles down to a red oak then north 42 east 220 poles crossing the s'd branch to the first station as by the s'd Patent appears TO HAVE AND TO HOLD the sd hereby bargained land & premises & every part thereof unto the s'd John Leveritt his heirs & to his their only proper use & behoof forever & the s'd Zachery Phillips for hiimself his heirs Exors & admrs. doth hereby covenant & grant to and with the s'd John Leverett his heirs & assigns that he the s'd John Leveritt his heirs & assings shall pay from time to time & at all times hereafter hold & enjoy the s'd premises hereby bargained with appurtenances free & clear of all former or other gifts, grants bargains, sales, dowers, judgments executions or other incumbrances whatsoever the quit rents becoming due to his majesty his heirs & executors only excepted & further that he the s'd Zachery Phillips his heirs & all & every other person & persons & his & their heirs any thing having & claiming in the s'd remises above mentioned or any parth thereof by from or under him them or any of them their or any of their heirs (except as before excepted) & to the cost & charges of the s'd John Leverett his heirs & assigns make do & execute all & every such further & other lawful reasonable act & acts thing & things conveyence & conveyances in the law for the further better and more perfect granting conveying & assuring of all & singular the s'd premises above mentioned with the appurtenances unto the s'd John Leverett his heirs & assigns & to his & their only proper use & behoof forever according to the true intent & meaning of these presents as by s'd John his heirs & assigns or his or their council learned in the law shall be reasonably advised or rquired. IN WITNESS WHEREOF the s'd Zachery Phillips to this presents his indenture both interchangeably put to his hand & affixed his seal the day & year first written.
