Witnesseth that the said William Thomas, for and in consideration of the sum of 6000 pounds current money of South Carolina aforesaid in hand paid before the ensealing and delivery of these presents, the receipt whereof his hereby acknowledged, hath given, granted, bargained, sold, ensealed, released, conveyed and confirmed, and by these presents doth give, grant, bargain, etc., unto the said PHILOMAN THOMAS, his heirs and assigns: “A certain part of the following tract of land which was conveyed to the said William Thomas by Samuel Wise by lease and release, dated the 24th and 25th day of November 1778, and tract thereof granted unto John Clark in North Carolina 500 acres on the 2nd day of October 1751, and by the said John conveyed unto Thomas Wade on the 26th day of June 1770, and by the said Thomas conveyed unto the said Samuel on the 14th day of July 1774. One other tract of land thereof granted unto Thomas Wade for 400 acres on the 17th day of May 1776 and by the said Thomas Wade unto the said Samuel on the 14th day of July 1774. Also one other tract of land thereof granted unto Philip Pledger for 150 acres on the __ day of November 1770, and by the said Philip conveyed unto Betty Wise on the 18th day of May 1771. Also one other tract granted unto the said Philip for 150 acres on the 31st day of August 1774, and by the said Philip conveyed unto the said Samuel on the ___ day of ____ ____. Also one other tract granted unto the said Samuel for _______________________________, to the said Samuel _______ for 1000 acres on the 9th day of June 1775 which hereby bargained and sold land and all of the above tracts of land that lies on the upper or Northwestern side of the following lines ______ and bounds, Viz.: “Beginning at a small sycamore tree standing near the mouth of White’s Creek on the upper side and thence running up and by with the creek to a sweet gum tree standing on the bank of the creek, thence crossing the creek to a small white oak standing on the bank of the lower side of the creek, thence North 46 degrees East 100 poles to a stake near the main road, thence North 20 degrees West by and with the main road to the said creek, thence crossing the creek and continuing the same course to a pine making from the said stake to the said pine 82 poles, thence North 29 degrees East 145 poles to a post oak standing near the side of the mill pond, thence bounded on the upper side of the swamp or low grounds of the said creek ____ [left blank] any of the said _______ [left blank] and sold land may join on the creek up the fork of the said creek where Andrew Henderson now lives lately called Samuel Wise’s Cowpens, thence on the left fork of the most northerly line of any of the said land, and for the other boundaries of the said hereby bargained and sold land, reference is had to the above ?rea?ted grants and conveyances.” “The said hereby bargained and sold land does not nevertheless include any of the above mentioned tracts of land than what was conveyed unto the said William Thomas by the said Samuel Wise on the 25th and 25th of November 1778, and lies on the upper side of the above mentioned courses and bounds. The said William Thomas doth also reserve unto himself the free liberty erecting any dam or dams across the said White Creek above where the sawmill now stands and of joining from the highland on the upper side of said creek and also of digging said dam or dams from the highland on the upper side for the same purpose of building said dam or dams, the said liberty meaning to ____ to the said William, his heirs and assigns forever, and also of raising the waters with such dam or dams to any height he the said William, his heirs or assigns may choose.
