All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Carolyn Shank carolynshank@msn.com April 30, 2007, 7:34 pm #4948 State of North Carolina Anson County On this 22nd day of March 1839, at the house of MARY ANN ELLET, widow of ROBERT ELLET, deceased appeared said widow before me, STEPHEN HASTY one of the Judges of the Court of Pleas & Quarter Sessions for the aforesaid County, aged 70 years who being first duly Sworn According to law doth on her oath makes the following Declaration in order to obtain the benefit of the Provision made by the Act of Congress the 7th July 1838, that she is the widow of Robert Ellet deceased who was a Private in the Army of the Revolution & she believes from his repeated conversation to her of his service that he was of the Militia & the forepart of his service in the Horse Company & she believes a Volunteer in every instance of his service. She recollects her husband state three services in this state three months each. She thinks his first service he was marched to Cross Creek now Fayetteville his officers then she does not recollect or dates. The next three months she believes was under some of the following officers also the next three months he was in the Battle at Ramsey's Mill and Brushey Creek she thinks some time after he was a Volunteer for six months a Private in the foot company & she thinks in that service he was marched South & was in Charleston & there helped build the breast works. He was again a volunteer six months a Private & was marched to the South he was in the Battle at Brier Creek that she has often heard him speak of the distress of the men in that Battle. She thinks that she heard him state that in these too (sic) six months service he was under different officers. The following officers he served under at different times Capt. Roger, Capt. Ramsey, Major Ramsey, Major Golson, Col. Scurlock, Col. Griffey. this is as far as she recollects at this time hearing her husband state, tho (sic) his services she thinks commenced with the war in this section of the County. She states her husband & self had no learning, in the time of the war they resided in Chatham County in the above state & was personally acquainted. They were married by Zachariah Harmon, a Justice of the Peace, she thinks about the close of the war in the year 1783 or 1784, for her husband served no more after they were married. Her husband has often stated to her that he was thirteen years older than her self. She has no register of her self husband marriage marriage or of her childrens ages. As well as she can recollect her oldest child a son will be 51 or 52, sometime in December next. He here resides, she thinks about 45 years past her husband moved to the above County & he resided here to his death which was the 18th day of September 1829, and she has continued to reside here & has not married since. She cannot make any further proof of her husband's service than what is here stated. She thinks his other discharges has been destroyed the lapse of time, the deaths, & the loss of memory puts it out of her power to make further proof of her husband's services. The possession she has followed forty five years past both by day & Knight (sic) to render her self a Service the weight of years on her & at this time not able to go out of the house without help that she is unfit to be halled (sic) 23 miles to a Court House there to declare what she has here done. The following are the names & ages of her children as far as she can recollect at this time. HASTY, JP X MARK I STEPHEN HASTY one of the Judges of the Court of Pleas & Quarter Session for the County of Anson State of North Carolina do hereby certify that I moved into this County forty years in Febury last that I became personally acquainted with ROBERT ELLIOTT & MARY ANN ELLIOT his wife & family. They resided near me they here continued to reside in one & a half miles of me and his widdow continues here to reside and has never moved since. STATE OF NORTH CAROLINA UNION COUNTY On this the ninth day of April AD 1855 before me the undersigned acting Justice of the Peace within & for the County of Union & State aforesaid, personally appeared MARY ANN ELLET, aged ninety one years, a resident of Union County in the State of North Carolina who being duly sworn according to law, declares that she is the identical MARY ANN ELLET widow of ROBERT ELLET deceased, who was a private in the Revolutionary War & for whose service she now draws a pension, under the following pension certificate of which I certify the following is a true copy viz. "War Department. Widows Pension. I certify that in conformity with the act of February the 2nd 1848, MARY ANN ELLET, widow of ROBERT ELLET, who was a private in the Revolutionary War, is inscribed on the pension list at the rate of Twenty three dollars & Seventy Seven cents per annum, commencing on the 4th of March 1848, & continuing for life, unless she should again marry ; in which case the pension is not payable after the time of such marriage. Given at ________ office of the United States, this 12th day of January one thousand eight hundred forty nine. Examined and countersigner W.S. Marcy. Secretary of War J.S. Edwards, Commissioner of Pensions Which pension certificate is marKed No. 2970 & is recorded in Pension office on the roll of Pensioners unDer the Act of Feby. 2nd page 208 vol. 1 GEO. JENKINS, Clk. That she has not again married, but remains still the widow of the said ROBERT ELLET, for the facts of whose service she respectfully refers to the evidence on file in the pension office, when she was placed upon the pension roll as also for the evidence of her marriage. She make this declaration for the purpose of obtaining Bounty Land of one hundred & sixty acres to which she may be entitled as the widow of said ROBERT ELLET on account of his said service, under the act approved 3 March AD 1855. She further declares that she has never appeared for nor received any land warrant under any act of Congress. She hereby appoints SAMUEL E. WALKUP of Monroe N.C. her true & lawful attorney with power of substitution to prosecute this her claim for land, to receive the certificate or the warrant when issued & to do all other acts necessary & proper in the premises. her MARY ANN X ELLET mark Sworn to & subscribed before me, on the day & year first above mentioned & I hereby certify that I know the said deponent MARY ANN ELLET herself to be the identical person she represents herself to be and & further that I have no interest in this claim. State of North Carolina Union County On this the ninth day of April 1855 before me the subscriber a Justice of the peace in aforesaid county, duly authorized to administer oaths personally came JAMES BIVENS aged 38 years & JONATHAN BAKER, aged forty nine years whom I know to be residents of the said County and State aforesaid, & persons whom I certify to be respectable and entitled to credit, & who being duly sworn, say that they were present and saw MARY ANN ELLET execute the foregoing affidavit, as I also myself say, by making her mark to the foregoing declaration & making oath thereto in due form of laws & they further swear that they are acquainted, as I am, with the said MARY ANN ELLET now present, & have every reason to believe from the appearance & statements of the applicant, from the current neighborhood report and from the pension certificate now in her possession that she is the widow of the said ROBT. ELLET, that they were legally married & that she in all other respects is really the identical person she represents herself to be further that .... (last page not included in packet).
