Joseph F. Dunlap makes application for such letters as for that he is one of three viz B. I Dunlap, Jane Wakins & himself, who ar first entitled, the widow being dead, the only othr child of Testator & sister of the applicant & said B. I. Dunlap & Jane Watkins, now the wife of Jas B Mendenhall, at this time a resident of South America, Brazil: applicant claims a preference before the Court, in that he has a larger interest involved in the Settlement of said testator's estate, having lived with him many years managing his affairs & and questions of importance will arise between the estate and the applicant, Benjamin I Dunlap, which can be better adjusted if the entire matter passed into some other person than the said Benjamin's hands. The applicant is also a legatee and devisee in said testator's will, & has an equal interest in the proper settlement of said estate. Applicant excepts the Statements of B I Dunlap's application as to certain land being sold under execution against C Watkins late about said applicant, in that he is advised that the sheriff could only sell said land as the property of said B I Dunlap. Covington c to Judge of Probate The applicant under leave of this Court, amends his application by stating that the testaor died ________ & possessed of a large real & personal estate; as to the amount that was or should have been in the hand of C Watkins, late & decd, he is unable to state with any certainty but believes it is or should be greatly mor than one hundrd and fifty dollars.
