I Francis Smith Sr. of the County of Anson and State of North Carolina, planter, being very sick and weak in body but of perfect mind and memory thanks be given unto God,.....this my last will and testament that is to say .... Item - give and bequeath unto my son Richard Smith a certain tract he lives on now, beginning on a bank of the PD west side of the river like wise three negroes (to wit) Dinah, Frank, and Tom and one sorrel horse.... Item I give and bequeath unto my daughter Unity Hammond a certain tract of land lying on Little Brown Creek, land that I bought of Joel Saunders, except one hundred acres to be taken off at the upper end and two negroes (to wit) Hannah, and Tempey and likewise one sorrel mare... Item I give and bequeath unto my daughter Sarah Pemberton a certain tract of land lying on Pinch Gut branch of Big Brown Creek containing three hundred acres of land to be taken off at the lower end of the whole body of land.likewise two negroes (to wit) Phillis and little hannah and ..... Item I give and bequeath unto my daughter Elizabeth Buchanan a certain tract of land lying on Little Brown Creek containing one hundred and fifty acres more or less likewise four negroes (to wit) Old Hannah, Old Will, Milly, and Young Will and.... Item I give and bequeath unto my son Francis Smith the land whereon I now live except such part as my executors shall see proper to lay off for my beloved wife Frances Smith [Frances Dumas pl] to live on during her natural life time, likewise all my lands lying on Buffalo Creek, likewise three negroes (to wit) Freeman and Bob and little Jude and their increase....to him forever. Item I give and bequesth unto my beloved wife Frances Smith, three negores (to wit) old Cloe, and Fhoney and Harry, likewise all my stock of cattle, sheep, hogs and also the wagon which is now belongng to the plantation together with all the plantation and carppenters tools of every kind with the beds and every individual thing .....except one bed and furniture to my daughter Elizabeth Buchanan.....to be poss'd during her natural life time and at her death every individual thing or things that I've left to her its my will and desrire that they shall be equally divided among my five sons, Richard, Francis Smith and David Smith and Nathaniel Smith and John Smith by them...except two horse creatures to be given at that time one to my daughter Elizabeth Buchanan and one to my daughter Sarah Pemberton... Item I give and bequeath unto my daughter Anna Smith, a certain tract of land lying on Pinch Gut branch containing three hundred acres of land distinquished by being called the Spring Place also three negroes (to wit) Charles and Hagan and Rachel and their increase and also a young bay mare with a star on her face and a bed... Item I give and bequeath unto my son David Smith all the lands that I took up joining the lands that his uncle David Dumas gave him also three negroes (to wit) Daniel and Patty and Robbin and their increase also a horse creature and one bed... Item I give and bequesth unto my son Nathaniel Smith a certain tract of land lying above the land I gave to my son Richard Smith also three negroes (to wit) Rose and James and Young Harry and their increase..also one horse creature and one bed... Item I give and bequeath unto my son John Smith a certain tract of land lying on Pinch Gut branch containing three hnudred acres ofland to be taken of the upper end of the body of land that lies on said Creek also three negroes (to wit) Big Jude and Young Cloe and Jesse and their increase also one horse creature and one bed Item I give and bequeath unto my five sons Richard Smith and Francis Smith and David Smith and Nathaniel Smith and John Smith the Fishery that I purchased of William Howlet by them and their heirs freely....And it is my desrie that my executors should upon receiving a right for said fishery give a right to said William Howlet for land on the south side of Buffalo Creek and on the West side of the thoroughfare.
