I, Thomas Gaddy of the County of Anson and State of North Carolina, being of sound mind and memory but being feeble in body do this 12 day of October AD 1854 make and publish this my last will and Testament. 1st It is my Will and desire that all my just debts of every kind be paid out of my Estate by my Executor herein after named. 2nd It is my will and desire that my wife Nancy Gaddy have all the property that I may own of every kind both real and personal at the time of my death (except what it may take to pay all my just debts as above named) during her natural life and after her death I wish it to be divided by sale or otherwise by my Executor herein after named as he may think best among my children and Grand children as follows: 3. It is my will and desire that my daughter Jane Gaddy have the sum of five hundred dollars in money. 4. It is my wish and desire that my son Thomas J. Gaddy hold in Trust for the separate use and benefit of my son Ellis D. Gaddy the sum of four hundred and fifty dollars, the interest of said four hundred and fifty dollars to be paid to my said son Ellis D. Gaddy annually by the above named Trustee and should my said son Ellis D. Gaddy die without bodily heirs the above named four and fifty dollars to be equally divided between all my children there may b e living at the time of his death by said Trustee (he reserving to himself a equal share of said money) that is an equal share with all my said children that may be alive at the time of my said son Ellis D. Gaddy's death as name above in this item 5th It is my will and desire that after the death of my wife Nancy Gaddy that my daughters Patsey Gaddy and Jane Gaddy ___ the land that I may own at the time of my death and should they both be without bodily issue It is my will that all of said lands be sold and the net proceeds of the same be equally divided between all my children then living (that is that may be living at the time said daughters death). 6th It is my will and desire that after the death of my wife Nancy Gaddy, that my daughter Jane Gaddy have a negro woman by the name of Mary and her child named Hauna 7. It is my will that after all the above named legacies are paid that the balance of my property be sold by my Executor herein after named and that the net proceeds of the same to be equally divided between all of my children then living and the children of any of my sons or daughters that may be dead at that time, said Grand children to receive among them the amount that their Father or Mother would be entitled tower they alive at that time. It is expressly understood that the children of my son Stephen H. Gaddy deceased receive no portion in this item until the sum of six hundred and thirty seven dollars and thirty seven cents ($607.37) is taken out of the portion that would be allotted to them, this amount is to go to all the rest of my children living or to the children of such as may have died in the same proportion as before named in this item, as I have paid the said sum of six hundred and thirty seven dollars and thirty seven cents to J. White former Sheriff in consequence of being my said son Stephen H. Gaddy's security to J. P. Leak. It is farther my will that the portion that may be allotted to my son Ellis in this item be held in Trust in the same manner and form as named in the fourth item of this my last will and testament by the same Trustee said Trustee to receive a reasonable percent out of the same for all of his trouble as Trustee 8. I hereby nominate constitute and appoint my friend George W.
