Return to the NCGenWeb Archives Table of Contents http://www.usgwarchives.net/nc/ncfiles.htm#NC ****************************************************************** The Will of Nancy Diggs (Will Book C pg 110, Anson Co., NC) In the name of God Amen I Nancy Diggs of the County of Anson and the State of North Carolina being of Sound mind and disposing understanding Calling to mind the mortality of all things knowing that it’s appointed to all once to die and after this the Judgment . do on this the 14th day of September in the Year of our Lord One Thousand Eight Hundred and fifty five make and ordain this my last Will and Testament in the manner following and first of all I wish my friends to bury me in a decent and Christian like manner and as it regards my worldly estate I Wish it disposed of in the following manner (to wit) My Wish and desire is that my negro girl Mary (a slave) to be sold and that my Executor have choice to sell her In privately or publickly as he may think proper for Cash or on a credit as he may think proper and for him to make a division of the moneys arising form Said sale in the following manner and first my Wish and desire is that my son Dixon D Diggs Should have One Hundred dollars of the money arising from the Sale of Said girl as a renumeration for his trouble with me in my declining years all the balance of the money arising from the sale of Said girl I wish it to be Equally divided amongst all my children (eight in number) with the following exception that is to say that part that that would fall to my daughter Lydia Preslar wife of Levi Preslar I give and bequeath to my son Dixon D. Diggs in trust and confidence for the sole use and benefit of my daughter Lydia Preslar and his children so that it shall not be subject to the control [?] Constitutions nor debts of her husband Levi Preslar in no way or manner whatsoever. And lastly I hereby nominate constitute and appoint my beloved son Dixon D. Diggs sole executor of this my last Will and testament hereby Revoking any and all former Wills and testament by me at any time to be my last Will and testament in Witness where of I have unto Set my hand and Seal in presence of this Witness whose were all present at the Signing and Sealing there of day and date first above written. her Nancy x Diggs mark Test.
