Badger to Ellen Badger State of North Carolina Ashe County This deed made this the 5th day of January 1901 by Alpha and W.H. Badger of Ashe County and State of North Carolina of the first part to Ellen Badger of Ashe County and State of North Carolina of the second part. Witnesseth that Alpha & W.H. Badger in consideration of one hundred dollars to them paid by Ellen Badger the receipt of which is hereby acknowledged have bargained & sold and by these presents do bargain sell and convey to said Ellen Badger her bodily heirs and assigns all the right title, interest and estate of the party of the first to a tract or parcel of land in Ashe County adjoining the lands of E. C. Eller, David Graybeal & others and bounded as follows; Beginning on a locust near the top of the ridge and running north 31 w. with Graybeal’s line 7 ½ poles to a stake there N. 3 W 14 poles to a sassafras sprout by the fence. There N. 60 W 4 poles to H.A. Ellers line there N. 6 ½ E. with Ellers line 45 poles to a stake in the road & 63E with the road 21 poles to a locust above the road S.73 E with road 13 poles to a stake S. 49 E. 6 poles to a stake in the road S. 73 E. with the road 9 poles to a stake at the fence S. 26 W. with fence 9 2/3 poles to a stake S. 43 E 3 ¾ poles to a stake in conditional line between W. H. Badger & J.E. Badger. There with conditional line by way of a bunch of walnuts above spring 51 poles to the beginning . To have & to hold the aforesaid tract or parcel of land and all privileges & appurtenances thereto belonging to the said Ellen Badger and her bodily heirs and assigns to their only use & behoof forever. And the said Alpha & W.H. Badger covenant that they are seized of said premises in fee have the right to convey the same in fee simple the same are Sell and Clear from all By State of North Carolina of the second part. Witness that Alpha & W.H. Badger in consideration of one hundred dollars to them paid by Ellen Badger the receipt of which is hereby acknowledge have bargained sold and by these presents do bargain sell and convey to said Ellen Badger her bodily heirs and assigns it the right title, interest and estate of the party of the first to a tract or parcel of land in Ashe County adjoining the lands of E.C. H. Badger & J.E. Badger. There with conditional line by way of a bunch of walnuts above spring 51 poles to the beginning. To have & to hold the aforesaid tract or parcel of land and all privileges & appurtenances thereto belonging to the said Ellen Badger and her bodily heirs and assigns to their only use & behoof forever. And the said Alpha & W.H. Badger convenant that they are seized of siad premises in fee have the right to convey the same in fee simple. The same are free and clear from all incumbrances and we will warrant and deferrd said title to the same against the claims of all persons whatsoever we futher agree to give J.E. Badger & wife right of way through said land running with E.C. Eller live also water from spring. The said Ellen Badger not to become in possesives of said lands until after the death of Alpha and W.H. Badger. In testimony whereof the said Alpha Badger and W.H. Badger and Alpha his wife personally appeared before me this day and acknowledged the due execution of the annexed deed of conveyance and the said Alpha Badger being by me privately examined separate and apart from said husband touching her voluntary executions of the same doth state that she signed the same freely and voluntarily without fear or compulsion of her said husband or of any other person.
