Badger & wife This indenture made this 3rd day of July in the year of our Lord One Thousand Eight Hundred and Eighty Four between W.H. Badger and Alpha Badger of the County of Ashe and State of North Carolina of the first part and T.E. Latham of the county of Ashe and State of North Carolina of the second part. Witnesseth Had (?)Her(?) said parties of the first part for asin(?) consideration of the sum of One Hundred & fifty Dollars in hand paid by the said parties of the second first the receipt sohereof is hereby acknowledged have Bargained and Sold Conveyed and Confirmed and by the presents do Bargain sell Convey and Confirm unto the siad party of the second part his hand(?)(?) (?) forever all the following described piece or parcel of land lying and being in the State of N.C County of Ashe and known and designated as follows (?); A farm adjoining (?) Ashley, Sam Sage, Gus Eller, John Jones and others on the Pounding Mill branch in North Fork of New River known as the Hubbard tract of land I have and to hold the same together with all the hureditaments and appointments thereunto anywise appertaining to him the said T.E. Latham , his heirs and assigns forever and the said W.H. Badger and Altha Badger parties of the first part do convenant with the said party of the second part his heirs and assigns as follows first that we are the owners and Profully serzed (?) of said premises second that we have a good right to convey the Same (?) that the same is free from all encumberances nohatever(?) and forth that the party of the second part his heirs and assigns shall quietly enjoy and possess the same and that of will warrant and ebfend(?) the title to the Same against all lawful claims foreced over theys(?) that if the said W.H. Badger and Althea Badger of the first part their heirs executors and administrators shall will and truly pay or casue to be paid to the said T.L. Latham surty(?) of the second part his heirs executors administrators or assigns the sum of one hundred fifty Dollars according to the condition of a certain Bond of even date herewith payable October first 1884 then this Deed to be null and Void otherwise to be in full force and effect but if half(?) Sahll be made in payment of the siad sum of money or the interest or any part thereof at the one herin before specifed for the payment thereof the said parties of the first part is such case (?) authorize and fully enpower the said party of the second part his heirs executors administrators and assigns upon written notice to parties of first part for 10 days that prompt payment is expected and in default thereof Sale will be made under the process of this Mortgage to Sell the said hereby intitled premises at public outery(?) at Clifton N.C. after first advertising the same then days and (?) that Same to the purchaser in fee simple and out of the money arising from such Sale to Tain(?) the principal and interest notice(?) shall then be due on the said Note together with all costs and Assignment(?) pay the Surplus(ifany?) to the Said parties of the first part their heirs executors administrators or assigns in testimony wereof the said parties of the first part have herein to set their hands and Seals the day and year first above written.
