ASHE COUNTY, NC - WILLS - Jacob Roten, 26 Aug 1895 ----¤¤¤¤---- Will of Jacob Roten Source: Ashe County, North Carolina Will Book, Page 36. Notes: This is the will of Jacob Roten (1824 - 1904). He was the son of Joseph 'Josiah' Roten (1784 - 1869) and Mary Carpenter (1780 - 1860?). Jacob's wife was Nancy Latham (1822 - 1900). In the name of God, Amen: I, Jacob Roten, of the County of Ashe and state of North Carolina, being of sound mind and body and realizing the uncertainty of life and the certainty of death, do hereby make this my last Will and Testament, as follows: Item 1st: I hereby give and bequeath unto my beloved wife, Nancy Roten all my personal property, household and kitchen furniture, farming utensils to hold and to have exclusive ownership and control during her life. Item 2nd: After the death of my said beloved wife, Nancy Roten, I further desire that after all my just debts are paid, and my funeral expenses discharged, that any and all property in the possession of my said beloved wife, Nancy Roten, at her death be equally divided among my three daughters, Rebecca Roten, Ada Roten, and Mary Roten. Item 3rd: That my said daughters, Rebecca, Ada and Mary Roten pay to my daughter Martha Sapp, the sum of twenty five dollars to be discharged in trade provided said sum is not paid to her sooner by myself or wife. Grigsby In the Superior Court North Carolina Ashe County A paper purporting to be the last Will and Testament of Jacob Roten, deceased is exhibited before me, the undersigned Clerk of Superior Court for said county by E. S. Robinson, and the due execution there of by the said Jacob Roten is proven by the oath and examination of John R. Latham, and E. S. Robinson, who being duly sworn doth depose and say, as follows: John R. Latham testified as follows, that he is a brother of S. R. Latham, whose name appease as a subscribing witness to the last Will and Testament of Jacob Roten, which is now shown him, bearing date of the 26 day of Aug 1895. That the said S. R. Latham is dead, having died about 1900. That he is well acquainted with the handwriting of the said S. R. Latham, having often seen him write and sign his name. That the signature of S. R. Latham, where the same appears as a subscribing witness to the will aforesaid is in the genuine handwriting of the said S. R. Latham. E. S. Robinson testifieth as follows: That he is well acquainted with the handwriting of Jacob Roten, the testator aforesaid having seen him write and sign his name and that the signature of the said Jacob Roten, where the same appears at the end of the said paper writing aforesaid, is in the genuine hand writing of the said Jacob Roten, who died, on or about August 1904.
