II, p. 631 11 May 1715 John PORTER of Beaufort Precinct, Bath Co. & William BRICE of Craven Precinct, Bath County, NC. This Indenture made the 11th day of May in the first year of our Sovereign Lord George but he Grace of God of Great Britain, France & Ireland, King defended of the faith & Anno Dom. 1715 Between John PORTER of Beaufort Precinct in the County of Bath in the Province of North Carolina, Esq’r of the one part and Coll. William BRICE of Craven Precint in the county & Province aforesaid, Esq’r of the other part. Whereas the most noble Henry DUKE of Beaufort, Palatine and the rest of the true & absolute Lords Proprietors of Carolina did by their Patent bearing date the 10th day of November Anno. Dom. 1713, Give Grant Sell alien Enseoff and confirm unto the above said John PORTER for the consideration of seventy pounds current money a tract of land containing seven thousand acres of land and marsh being an Island lying and being on the Sandy Banks int he County of Bath between Drum Inlet and Topsail Inlet. To have and to hold the said land with all privileges of hunting hawking fishing and fowling wth all Woods Waters and Rivers together with all profits commodities and Hereditaments to the same belonging or appertaining except one half of all Gold and Silver mines unto him the said John PORTER his heirs and assigns forever Yielding & paying yearly every twenty ninth day of September unto the said Lords proprietors their heirs and successors the fee rent of Six Pence for every hundred acres hereby Granted to be holden of them their heirs & Successors in free & common —— as by the said Patent relation being thereunto had may more amply particularly appear. Now this Indenture, Witnesseth, that the said John PORTER for and in consideration for the sum of two hundred and sixty pounds current money of the above said province to him in hand paid at and before the Ensealing and delivery of these presents the Receipt whereof he doth hereby acknowledge hath Granted Bargain Sell Alien and confirm unto the said Wm. BRICE his heirs and assigns for ever all the above granted tract of lands with all the privileges profits commodities advantages and other the appurtenances thereto belonging or in any ways appertaining and thereto Granted or meant and intended to be granted to the said John PORTER his heirs and assigns by the above recited Patent and also all the Estate Right Title Interest Property Claim and demand whatsoever of him the said John PORTER of in and to the same tract of land and every part and parcel thereof. To have and to hold all and singular the above said tract of land and all other the premises hereby Granted or intended to be Granted and every part and parcel thereof with their and every of their privileges and appurtenances unto the sd. Wm. BRICE his heirs & assigns forever. The reserved Rent of Six Pence per hundred acres & the half of the Gold and Silver mines as are due or hereafter to become due to the Lords Proprietors their heirs and Successors excepted and the said John PORTER for himself his heirs Exr’s & Admr’s the said tract of land and every part and Parcel thereof and all and singular advantages & appurtenances thereto belonging and hereby granted or meant and intended to be hereby Granted as well against him the said John PORTER his heirs Exr’s and Admr’s as against all and every other person or persons whatsoever to the said Wm. BRICE his heirs and assigns shall and will Warrant and forever defend by there presents. In Witness whereof the parties hereunto have interchangeably set their hands and seal the day and year first above written. John PORTER (Seal) Rec’d of the above name Wm.
