Personally appeared before me William Orrel One on the Acting Magistrates or Justices of the peace for the County & State afsd — on the Ground herein mentioned, at the Beginning Expressed herein Viz Darby Hagen who having been sworn on the Holy Evangelist of Almighty God, deposeth and saith as followeth relating to the begining of the rigney land on the West side of Blounts creek, patented by David Dupeet, as follows, Darby Hagen having been sworn as above, saith that he saw James Brooks begin to run Out the Land of James Rigney, the Grandfather of said Brooks, at a white Oak standing on the point near the Creek, supposed by some to be the point formerly called pasture point, and was a chain bearer at the time that the said Brooks began & run the lands as above, and that he understood from the said Brooks that the said Oak was the proper begining of said Land, which said survey was made at or about twenty years since, the Oak being a marked tree, since which time no person has with confidence positively disputed the sd Oak as the proper begining of the said Land and further the Deponant saith Not.
