Jasper Executor of the estate of Selden Jasper decd - to the Petition of William L.B. Pearce administrator de bonis non of the estate of Lazarus Pearce. This defendant saving & reserving to himself the benefit of all just exceptions to the Petition of the said petitioner: for answer thereto says that Lazarus Pearce, died, that he made his last will & testament, appointed as executors thereof the persons stated in said petition, in manner as stated in said petition,: that Patsy Pearce qualified, as in said petition is charged: but what amount of personalty of said Lazarus she took into her possession he knows not: That as to the negro named Quamner: which is charged to belong to the Petitioner he admits that said negro did remain in the possession of the said Patsy until her intermarriage with Selden Jasper, in 1806 or thereabouts, as charged in said Petition and remained with Selden Jasper until his death about August A.D. 1812: and he also admits that said Selden Jasper died at or about that time as aforesaid, that he made his will & thereof appointed as Executor Thos. H Blount Wm. Blount and this defendant, and that this defendant is the surviving executor of those persons who have as yet qualified to said will: This defendant denies that he ever received into his possession said Negro Quamner, nor did his executor that qualified namely William Blount, to his knowledge receive said negro into his possession: but he says that to the best of his knowledge & belief, the said negro went into the possession of Henry Blount the guardian of said petitioner about the year 1813, about the month of August in the year A.D. 1812. This defendant does not know for what pays the said negro would have hired, when in the possession of the said Patsy Pearce and in the possession of Selden Jasper. This defendant also says that about the year 1806 There was an audited account of the said Patsy Pearce as Executrix of the said Lazarus Pearce, with the distributees of the said Lazarus Pearce, by which: upon a balance being struck, there appears to be due to her the sum of $ From the estate of the said Lazarus, & all the negroes and personal property of the estate of the said Lazarus, were sold to pay the debts of the said Lazarus except the said negro Quamner. Which was alone left to pay the said balance, and to be hired out for the support of the said Petitioner, and his maintenance and education: And this defendant believes that the said Selden Jasper after his intermarriage did hire out said negro, for the payment of the said balance, and the support & education of the Petitioner. And this defendant further says, that at August Term A.D. 1812 he qualified as Executor of the will of the said Selden Jasper deceased; & that as before stated in his answer, he never did take said negro Quamner into his possession: and that no action, suit, petition or demand has been made of brought against the said estate of the said Selden Jasper within seven years from the death of the said Selden Jasper: Matthew Shaw Atto. For Defendant John B. Jasper maketh oath that the facts stated in this answer , as of his own knowledge, are true, and those that are not of his own knowledge he believes to be true: November Term A.D. 1825 of Hyde Court of pleas and Quarter Sessions.
