Original filed in Deed Book 173, page 392, Beaufort County, NC DIVISION OF PROPERTY OF FREDERICK DOWNS Know All Men By These Presents: That whereas, Frederick Downs died intestate in Beaufort County, many years ago, prior to 1850, being seized in fee and the owner of several tracts of land; and Whereas, he left seven heirs-at-law, to-wit: Frederick Downs, Daniel D. Downs, Shadrack Down, Patsy Downs, who married Emanuel Taylor, Pagy Downs who married John Nobles and Susan Downs, who married Everrad Warren and Ellen Downs who was never married; and Whereas, the said heirs at law had an actual division of the lands of their ancestor, Frederick Downs, and each heir at law went into possession of the part allotted to him in said division; and Whereas, said division was never reduced to writing and no record thereof has ever been made; and Whereas, we the undersigned descendants of said Frederick Downs, are knowing to the division and desire to perpetuate our knowledge about this matter. We do certify as follows: That Britton Downs is the son of Frederick Downs, Lacey N. Downs, is the son of Shadrack Downs and Amos Taylor is the son of Patsy Downs, who married Emanuel Taylor, and we do certify as follows: that the share of Frederick Downs, Pagy Nobles, wife of John Nobles and Patsy Taylor, wife of Emanuel Taylor took the tract known as the Downs Pine Ridge, containing one hundred acres as their share in their said father's estate: each of them holding an undivided one-third interest in said tract. That Dawson Downs, Ellen Downs, Susan Warren and husband Everrard Warren, each took their share in the tract known as the home tract, where their father lived, and they jointly sold the tract to John N. Carney. Shadrach Downs took his share of land between the ditches, so called, and known as the forty acres patent. We do further certify that our information in said matter comes from our ancestors. The said Lacey N. Downs, states, that he had heard his father & Daniel Downs, Susan Warren and Ellen Downs state that this was the division and that the same was satisfactory to all parties concerned. Amos Taylor does certify that he has heard his mother Patsy Taylor and his father Emanuel Taylor state that the above the division and that it was satisfactory; he also states that he has heard the other heirs, viz: Frederick Downs, Shadrack Downs, Daniel Downs, Susan Warren and Ellen Downs state, that the above was the division and that it was satisfactory. Britton E. Downs, states, that he had heard his father, Frederick Downs, also his Uncle Shadrack Downs and Daniel Downs, and his aunts, Susan Warren and Ellen Downs state that the above was the division and that the same was satisfactory. F. F. Taylor, son of Emanuel and Patsy Taylor and John T. Downs, son of Daniel D. Downs, certify, that they have heard their respective parents state that the foregoing was the division between the parties and that the same was satisfactory to all concerned; and Whereas, we the undersigned desire to perpetuate our knowledge about this matter for coming generations.
