All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Kathy Wilde wildekat@hotmail.com November 13, 2005, 11:23 pm Written: March 7, 1811 North Carolina Beaufort County This Indenture made this 7th day of March in the Year of Our Lord 1811 between Wesley Floyd, Levina Floyd & Bazil Floyd of the One part, and Joseph B Hinton of the Other part all of the County & State afsd: Witnesseth, that for and in consideration of the sum of two dollars for every Acre hereby bargained & sold, into our hands paid by the said Joseph B Hinton, the receipt whereof us & each of us do hereby acknowledge Ourselves contented satisfied and paid, have bargained sold transferred and delivered, unto the said Joseph B Hinton his heirs, Executors, Admrs and assigns forever, a certain tract or parcel of land lying & being in the County of Beaufort on the West side of Blounts creek Begining at a White Oak on the point commonly Called the pasture point, or so designated at the time the land was formerly surveyed by David Dupea, and particularly at the time the land was surveyed by James Brooks and also Established to be the Pasture Point by the Oaths of Darby Hagan and James Herrington, as per the deposition of those two persons hereunto Annexed, taken before William Orrel Esqr which sd. pasture point is a point on Dupeas Creek, and the Oak Standing near the declivity of the hill — And run S 20 W 320 poles to a pine, Rigneys corner, thence S 45 E. 80 poles to the center of three pines, thence S 83 E 40 poles to the center of three pines, then N31 E 86 pole to Taylors Branch, the Western prong of the Pasture Creek to a Water Oak, a gum & an Ash, thence down the branch with winding of the run threrof, to where it empties into the pasture creek, then with the winding of the pasure Creek to where it emties into Joes Creek, thence down Blounts Creek with the windings thereof to where it forms a confluence with Dupeas Creek. from thence up Dupeas Creek, with the winding thereof to the first Station, as Surveyed by Miles Chauncy Esqr in presence of Wesley Floy [d], Joseph B Hinton and Other persons whose signatures appear to the affidavids hereunto Annexed, Containing by Estimation Calculation of the said Miles Chauncy. Five hundred & thirty three Acres, with all the Improvements & privaledges thereunto belonging or appertaining or to belong or appertain, Which Said Land at the above sum of two dollars pr acres amounts to $1066 dollars which we acknowledge to have received, and Ourselves for every part & parcel thereof paid. this land is a tract that Originally was patented by David Dupea and by him sold to Jonas Rigney which fell into the hands of James Brooks as heir at Law he supposing a part thereof Vacant Patented two hundred Acres, as per the patent to sd James Brooks from whom the Land desended to Lavina Floyd [&] Sally Pearce. Sally Pearce dying gave her rights thereof to Bazil Floyd and Wesley Floyd made Interested by some Exchanges between Said Bazil Floyd & himself Vesting the whole Title of said Land, in Lavina, Wesley & Bazil Floyd, the three Obligors to this deed. For a particular description of the title, Refer to James Rigneys Deed to Elizabeth Rigney. Elizabeth Rigneys will, James Brooks will, Sally Pearces Will and the Patent of James Brooks. Now Know ye that for and In consideration afsd I the said Lavina Floyd Wesley Floyd and Bazzell Floyd, do Compleatly Vest the title of the said Land in the Said Joseph B. Hinton, his heirs and assigns forever, as herein described and we, and Each of us, do warrant and forever defend the Claim, right Title and possession of the said Land as herein described and every part and parcel thereof to the said Joseph B Hinton, and his Heirs and assigns to be forever by them, to be enjoyed free and clear of all Mortguages, leases, deeds, Gifts, claims and all Embarrasments of Whatsoever description — to be Solely held by him & them Peacably & quietly, as will from us as from our heirs, and from all persons of every description from this time henceforth. And the said Levina, doth hereby declare her two sons Wesley & Bazzill Floyd whose Signatures here appear — are of Lawfull Years to Sue and be Sued, Plead & be Impleaded.
