James Herrington, having been sworn as afsd deposeth & Saith that fifteen or 
more Years since, that he James Herrington, was standing with James Brooks on 
a point of Land of James Rigney, patented by David Dupea, when the said James 
Brooks pointed to him the Begining of the said Lands, which was an Oak, 
marked, Standing on the point near the Creek Called Dupeas Creek, which which 
said point was supposed by some to be the point formerly Called Pasture point, 
which said begining he the said Herrington has not heard confidently disputed, 
Which begining is the begining that Darby Hagen has pointed out a the begining 
and further this deponant saith not.

George Gerard & James Herrington, having sworn on the holy Evangelists of 
almighty God declareth, that they will justly honestly and correctly measure 
with the chain, as chainbearers in the surveying of the said land, this day to 
the best of their Skill and ability.  Done at the begining Tree.
