This Indenture made the 30th day of March 1757. Between James Ellison, Sheriff of Beaufort County, of the one part and Timothy Mark, Taylor (tailor?), of the other part. Whereas Edward Hocut late of the said County was possessed of a tract of land herein after mentioned, and whereas John Ligley lately in the General Court of North Carolina did recover against said Edward Hocut in his life time and John Hamilton one judgment for one hundred and twelve pounds thirteen shillings of our provincial money by reason of a trespass commited and done by said Edward Hocut and John Hamilton, and whereas a writ of fierfa facias issued out of the said Court upon the law judgment to make of the Goods and chatels of said John Hamilton, the aforesaid sum of money with the costs of suit recovered as aforesaid, the said writ having been returned in whatsomanner the same was executed. it appearing that the sum of thirty two pounds, nineteen shillings and four pence provincial money and also the sum of thirty one pounds eight shillings four pence for cost of charges hath not been hitherto paid or satisfied to the said Ligley in his life time Margaret the wife and executor of the said Testament and will of the said John Ligley by a suma facias returned by the Sheriff of Beaufort County, that he has made known to Timothy Mark and Martha his wife, executors of the testament and last will of Edward Hocut, deceased, in the presence of sufficient witnesses of free holders to render the said judgment and the same being derived by the said Margaret, Exec. of the said John, a writ of feira facias paid out of the Supreme Court held at New Bern the 26th of September 1755 returnable to next March Court, and was directed and delivered unto the said Sheriff in form of law to be executed; which said Sheriff on the day and year aforesaid by virtue of the said writ hath entered into and upon the said tract of land, levied and taken the same as the land tenement of the aid Edward Hocut, deceased. Now this Indenture Witnesseth that the said James Ellison in pursuance of the said writ, caused the said tract of land to be sold at public vending and in consideration of Seventy three pounds provincial money, to him by the said Timothy Mark who was the highest bider at the said Sale, in hand paid, Hath bargained and Sold and by these presents duly clearly and absolutely bargain and sell unto Timothy Mark, his heirs and assigns the above tract of land containing (100 or 200) acres be the same more or less, Situated near Bath Town in Beaufort County, buted and bounded on John Brady; and all the estate right title claim interest and demand of the said Edward Hocut, dec., or his heirs . . . to the same. To Have and to hold the said tract of land and premises to the said Timothy Mark his heirs and assigns forever. In Witness whereof the said James Ellison hath hereunto put his hand and Seal the day and year first above written.
