Original is filed in Deed Book 6, page 398, Beaufort County, NC State of No. Carolina } Beaufort County } To all to whom these presents shall come I Charles Kelly send Greeting: Kno ye that I the said Charles Kelley for and in consideration of the natural love & affection which I have and bear unto my beloved son Tully Kelley, as also for the sum of Six Shillings lawful money to me in hand paid by said Tully Kelley the receipt whereof is hereby acknowledged have granted bargained and sold assigned over a certain piece or parcel of land lying in Martin County on the south side of Thomas Hunters Milll Pond beginning at a posimmon Tree on John Gadus and in the mouth of a little branch, thence up Gadd's line to his corner a pine tree along his line to Whitehouse to line, then down Whitehouses line to a corner a Spanish oak on the mill branch thence down the branch various courses to the beginning. To have and to hold the aforesaid tract or parcel of land with the appurtenances to the said belonging unto Tulley Kelley his heirs & and also all and singular the residue of my estate both real and personal of whatever Nature and whereever the same may be found; and I the said Charles Kelly the afs. land & tenement Goods & Chattels and personal Estate, and every part and parcel thereof unto my afs. son Tulley Kelly his heirs will warrant & forever defend by these presents. In Witness whereof I have hereto set my hand & Seal this 7 day of June 1791. Provided nevertheless that the foregoing Deed of Gift for the land and Tenements, Goods & Chattels therein mentioned shall remain unto the use of the afs. Charles Kelley and Sarah his wife during their joint lives, and the life of the longest lived of them and the said Tully Kelley is by no means to dispose thereof without providing other and sufficient means for the maintenance of the said Charles & Sarah Kelley, upon which condition the said Tulley Kelly accepts and proves the above donation.
