BARROW, both of Beaufort Co., NC-400 acres of land seized of Wm. HOOTEN. 15 January 1825 This Indenture made the fifteenth day of January — of our Lord One Thousand eight hundred and twenty five between Stephen OWENS, Esquire, Sheriff for the County of Beaufort of the one part and William BARROW of the County of Beaufort and the other part. Whereas, by virtue of and execution ensuing from this County Court of Beaufort being numbered 27 Estimable to May Term 1822 at the instance of William BONNER against William HOOTEN for the sum of Sixteen pounds thirteen shillings and nine pense debt, damages, costs and charges inclusions, which said sum was as covered by said William BOONER against said William HOOTEN as one record of said Court may appear. And whereas the said Execution was described and delivered to the said Stephen OWENS, Esquire, Sheriff as aforesaid commanding him that of goods, chattels, Lands and Tenements of the said William HOOTEN he should cause to be made the aforesaid sum of Sixteen pounds thirteen Shillings and nine pence cash included to Satisfy the said execution, with the Costs thereon accruing; and the said Stephen OWENS, Sheriff as aforesaid, in pursuance and by virtue of his Office, would? the aforesaid Execution, did Seize and take into his house? do used certainty no goods or chattels to be found, a certain piece or parcel of land lying and being in the Said County of Beaufort, bounded as follows: On the East, North and West by the lands of Rathius JORDAN, Dec’d and on the South by the lands of Joshua BAILEY, Dec’d and others containing four hundred Acres more or less being the land whereon the said HOOTEN now lives on Tarkiln Neck Road. And the said Stephen Owens, Sheriff as aforesaid, after due Advertisement recording to Land? did cause the said piece or parcel of Land, with all the appurtenants thereunto belonging to be put up at public Sale to the highest bidder on the Twentieth day of May in the year of our Lord One thousand eight hundred and twenty two (1822) at the Court House in Washington at which time and place William BARROW became the last and highness bidder at the sum of seventeen pounds eight Shillings and four pense for the said lands with the appurtenances thereunto belonging: and at which price the same was struck off to said William BARROW. This Indenture Witnesseth, That the said Stephen OWENS, Sheriff of the county aforesaid, for and in consideration of the said Sum of Seventeen pounds eight shillings and four pence to him in hand paid by the said William BARROW at and before the sealing and Signing of these presents; the Recipt whereof is hereby acknowledged, he the said Stephen OWENS, Sheriff, doth hereby bargain, sell, enseoff convey and confirm unto said William BARROW his heirs, executors, Administrators or Assigns forever all the aforesaid lands, Tenements and appurtenances with all right, title claim or claims for unto the aforesaid piece or parcel of land, with all hereditaments and enrollments to the same belonging or in anywise appertaining. To have and to hold to him the said William BARROW hashers executors, Administrators or Assigns forever, in as full & ample a manner as he the said Sheriff, is empowered by the virtue of his office. And for the said Stephen OWENS, Sheriff doth hereby covenant promise and — to and with the said William BARROW his heirs, Executors, Administrators, and Assigns who still and may from time to time and at all time hereafter, have hold and assign, possess and enjoy the said premises with this appurtenances free and clear of and from all encumbrances had — done or committed by him the said Stephen OWENS, Sheriff or by his order, means or procurement and that he the said Stephen OWENS, Sheriff will warrant and defend the same to the said William BARROW his heirs, executors, Administrators or Assigns forever, so far and his Office of Sheriff will admit? and no further. InWitness whereof the said Stephen OWENS, Sheriff of the County Aforesaid hereunto set his hand and Seal the day and year above written.
