All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Kathy Wilde wildekat@hotmail.com November 6, 2005, 12:40 am Written: February 10, 1825 Recorded: February 1825 Whereas a certain writ of Venditioni Exponeas issued from the Court of Pleas & Quarter Sessions of the County of Beaufort returnable to November Term 1821, at the Suit of the President & Director of the State Bank of North Carolina, against Slade Pearce and John Kennedy for the sum of one hundred & fifty Pounds for debt and six pounds 16/. for the Costs and Charges which had been previously levied on the Land and plantation of Slade Pearce, whereon he then resided and on two Lots with their improvements in Van Norden Town and Eight negroes, all the property of the said Pearce, commanding the Sheriff to make the said monies by the Sale of the said property and the said Writ was directed & delivered to Allen Grist Esqr Sheriff of Beaufort County at that time acting as such who by virtue of his Office & in obedience to the said mandate did duly advertise the said property and sold the said described house and Lot in Van Noorden Town, on the last Thursday in Oct 1821 at the Court House in Washington, to Richard Grist the last & highest bidder for three hundred & ten dollars. Also two other certain writs of Venditioni Exponeas from said Court, returnable to February Term AD 1822, at the suit of the President & Director of the Bank of Newbern, one against the said Slade Pearce, Thomas Trotter and James OK Williams for Seven hundred & fifty pounds. Debt and the sum of Seven pounds 10/6 costs & charges the other against the said Slade Pearce John Kennedy and James OK Williams for Nine hundred pounds debt and the sum of Seven pounds 10/6 cost & charges. — both of which had been previously levied on the Lands & plantation of Slade Pearce, on Blounts Creek where the defendant lives and two houses & Lots lying and being in Van Noorden part of Washington, say Lots No. 31 & No 32 together with their improvements and the wharf thereunto annexed & thirteen Negroes commanding the Sheriff of Beaufort to make the said monies by the Sale of the said property. And the said two writs were directed and delivered to Allen Grist Esquire, then the high Sheriff of said County — who by virtue of his said office & in obedience to the said writs, did, after giving due & lawful notice by public advertisement Sell at the Court House in Washington on the last Thursday in January 1822, that is to say the said Land & plantation to Richard Grist. (on Blounts Creek) for the sum of One hundred & ten Dollars he being the last & highest bidder. Also one other certain writ of Vend. Exponeas from the said Court, returnable also to February Term 1822, at the Suit of Richard Hines against the said Slade Pearce for the sum of two hundred & Eighteen pounds 8/6/ for debt and the sum of five Pounds & 3s costs & charges — which writ had been previously levied on all the interest of Slade Pearce of & in two certain Lots with their improvements, lying & being in Van Noorden Town, adjoining the bridge where the Tin factory was then established & carried on Say lots No. 26 & No 27 in Van Noorden part of Washington and the said Sheriff, did, after giving due public Notice thereof, sell the said interest of Slade Pearce of and in the said lots, at the Court House, in Washington on the last Thursday in January 1822, to Richard Grist for the sum of Forty Dollars, he being the last & highest bidder. Now therefore, I Allen Grist, high Sheriff as aforesaid, in virtue of my office & for the consideration of the Sum of Three hundred & ten dollars to me in hand paid by the said Richard Grist before the ensealing of these presents, have give granted and by these presents do give & grant transfer & Set over unto him the said Richard Grist & his heirs the two lots where Slade Pearce last resided in the Town of Washington & known & distinguished in the plan of Van Noorden part of Washington by Number thirty one & thirty two (No. 31 & No. 32) together with the water front & wharf and all the appurtenances. And for the sum of one hundred & ten Dollars to me in hand paid, by the said Richard Grist before the ensealing of these presents I do hereby bargain & Sell transfer & Set over unto him, the said Richard Grist & his heirs, all that body of Lands & the plantation owned by Slade Pearce on Blounts Creek. & where he last resided – reference to the deed or deeds therefor will more fully & at large describe the boundaries thereof — adjoining the land of Joseph Pearce and William Blackledge and others together with all and singular the appurtenances. And for & in consideration of the sum of forty dollars, to me in hand paid by the said Richard Grist before the ensealing of these presents, I do hereby give and grant bargain & Sell transfer and set over unto him the said Richard Grist & his heirs all the undivided Interest & property of Slade Pearce of and in the two Lots in Van Noorden part of Washington— known & distinguished in the plans of said part of Washington by Numbers twenty six & twenty seven — adjoining the Bridge, and whereon the Tin factory was for some time carried on – together with the water front and wharf and the improvements of said Lots with all the appurtenances which undivided interest and property was one half of the said two lots and one half of all & every their appurtenances. To have and to hold unto him the said Richard Grist and his heirs & assigns forever — the said Lots and parts of lots and lands & plantation with all & singular the respective appurtenances to the same belonging or in anywise appertaining. And I the said Allen Grist Sheriff do hereby covenant to and with the said Richard Grist that I will warrant and forever defend to him and his heirs, the property of the said Slade Pearce, of and in the said several described pieces of property, from the claim of all and every person so far as I can do by virtue of my said Office & no further. In Testimony whereof, I the said Allen Grist have hereunto set my hand & seal officially, this 10th day of February 1825. One Thousand Eight hundred and twenty five. Allen Grist Sheriff Signed sealed & delivered in presence of Test: Terrence Delany February Term 1825. Beaufort Co. Pleas and Quarter Sessions. Then the execution of the within Deed from Allen Grist Shff to Richard Grist was proven in Court by the oath of Terrence Delany a Subscribing Witness thereto, let it be Registered.
