All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Kathy Wilde wildekat@hotmail.com October 26, 2005, 3:26 am Written: March 22, 1826 Recorded: May 1826 State of North Carolina Beaufort County Whereas Thomas Smaw heretofore by his deed bearing date the 25th day of August 1825 did convey unto Mathew Shaw amongst other property a certain negro Slave named Jim about the age of twenty five years upon certain trust mentioned in said deed: and whereas the Said Thomas Smaw havening agreed to and with James Willis to Sell and convey the Said Negro Man named Jim to the Said James his Executors administrators and assigns unto the Said James paying unto William Ellison the Sum of Four hundred Dollars has requested the Said Mathew Shaw to make title to the Said negro Slave named James and the Said James Willis upon the payment by the Said James unto William Ellison afsd the said Sum of Four hundred Dollars and has directed the Said Mathew not to Sell Said negro Slave named Jim at public auction in the manner mentioned in the said deed but to make a deed to said James Willis for Said Slave without Such Sale at auction. Now therefore the Said James Willis having before the Sealing of these presents paid over to Said Mathew Shaw the Sum of Four hundred Dollars as is Witnessed by the Said Mathew having Sealed these presents and the Said Mathew having paid over unto the Said William Ellison at the request of the Said Thomas Smaw the Said Sum of Four hundred dollars as is Witnessed by the said Thomas Smaw and the Said William Ellison having Sealed these presents: and the said Thomas Smaw having directed the Said Mathew Shaw to convey in pursuance of his contract with the Said James Willis therefore the Said Mathew Shaw have given granted bargained and Sold and conveyed unto the Said James Willis his executors administrators and assigns to have and to hold the Said Slave to him the said James Willis his Executors Admrs and assigns — To his and their own proper use and behoof but without any Warranty on the part of the Said Mathew as to the title of Said Slave and the Said Thomas Smaw and the sd William Ellison do hereby covenant and agree to and with the said James Willis his Executors adms and assigns. In witness Whereof the parties hereto, to wit, Thomas Smaw, Mathew Shaw and William Ellison have hereunto set their hands and Seals this twenty second of March AD 1826.
