All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Kathy Wilde wildekat@hotmail.com November 5, 2005, 1:07 am Written: March 8, 1824 Recorded: November 1824 Be it known that certain writs of Venditioni Exponas from the County Court of Pleas & Qr Sessions of the County of Beaufort, returnable to November Term A D. one thousand eight hundred & twenty-two, that is today, one at the suit [of] Keais & Rees to the use of Abraham Raven against John Smaw for the sum of eight pounds five Shillings besides interest & cost, and one at the suit of John Peed to the use of Samuel W. Lucas against the Said John Smaw for the sum of nine pounds thirteen Shillings & five pence, besides interest & cost and one at the suit of John Peed to the use of Saml W. Lucas against the said John Smaw & Thomas Ellison for the sum of Sixteen pounds nine Shillings & besides interest & costs; and one at the suit of John Vines to the use of Robert B. Eborn against the said John Smaw & Aaron Eborn for the Sum of Six pounds Seventeen Shillings & one penny, besides interests & costs — and the said writs were directed & delivered to Stephen Owens Esq high Sheriff of the county of Beaufort, commanding him to make the said monies by the Sale at auction for ready money, one tract of land containing four hundred acres and one other tract containing fifty; both of said tracts the said John Smaw purchased from William Smaw & reference to that deed will more plainly Shew, also a tract containing Six hundred and forty acres joining the above land, which John Smaw purchased from Thomas B. Houghton Trustee of the University — all of which land had been lived on and Seized under writs of Fieri facias in the said Cases as the property of the Said John Smaw: and the said Stephen Owens high Sheriff, in Virtue of his said office and pursuant to the directions of the said writs of Vind. Exps did legally advertise all the said property, and on the day fixed for the Sale in the advertisement vizt on the Seventeenth day of November A.D. one thousand eight hundred & twenty three, at the door of the Court House of the Said County did offer to the highest bider the property aforesaid under the said writs of Vind:Exponas, & then & there William Ellison became the purchaser he being the last & highest bider for the whole of Said lands, at the Sum of one hundred & fifty one Dollars, for James and William Ellison, and the said William Ellison having ??? the purchase afsd was made by him for the benefit of James & William Ellison he requested of the Said Stephen Owens high Sheriff as aforesaid that the title therefore be made to the said James & William Ellison. Now therefore I Stephen Owens high Sheriff of the said County, for & in consideration of the sum of one hundred & fifty-one Dollars to me in hand paid by the said James & William Ellison at or before the Sealing hereof, I have bargained & Sold, and do by these presents bargain & Sell, alien transfer & Sell over unto the said James & William Ellison, their heirs & assigns forever the lands & plantation whereon John Smaw now lives including all the lands Said John Smaw purchased of Wm. Smaw on Durhams Creek, reference being had to the deed from William Smaw to John Smaw will more fully appear: & including also the lands that John Smaw purchased of Thomas B Haughton Trustee for the University, reference being had to that deed will also more fully appear. To have and to hold unto the said James & William Ellison, their heirs & assigns forever all the lands tenements, hereditaments & appurtenances afsd. to them & their sole use benefit & behoof and the said Sheriff do thus hereby covenant to & with the said James and William Ellison & their heirs that all the rights, title claim, property & interest of this the said John Smaw of & in the said premises afsd & all other the appurtenances from the claim or claims of all manner of persons he will defend so far as he can do by Virtue of his said Office and no further.
