Manarin Vol. 1, Artillery 1st. Co. H, 40th Regiment N.C.T. (3rd Regiment N.C. Artillery) This company of light artillery, known as the "Branch Artillery," from Craven County, was mustered in at New Bern, January 30, 1862 as "Captain Alexander C. Latham's Company of North Carolina Volunteers." When Captain Latham resigned on September 16, 1863, 1st Lieutenant John R. Potts was promoted, and the company became known as Potts' Battery. It served as an unattached company until officially reported as Company H, 40th Regiment N.C. Troops (3rd Regiment N.C. Artillery) on the September-October 1863 muster roll. Being the first company to serve as Company H in this regiment, it was later referred to as 1st Company H, 40th Regiment N.C. Troops (3rd Regiment N.C. Artillery). Born in Beaufort County where he resided as a clerk and was appointed 1st Lieutenant at age 22, to rank from January 20, 1862. Promoted to Captain September 16, 1863. Present or accounted for until transferred to Company F, 13th Battalion N.C. Light Artillery November 4, 1863. Company F This company of light artillery, known as Captain John R. Potts' Battery, was 1st Company H, 40th Regiment N.C. Troops (3rd Regiment N.C. Artillery). It served under that designation until November 4, 1863 when it was assigned to the 13th Battalion N.C. Light Artillery as Company F. Captain Potts was killed in action at Spotsylvania Court House, May 8, 1864, and 1st Lieutenant Henry G. Flanner was promoted. The battery then became known as Flanner's Battery, after its Captain. John R. Potts Capt. Co. F, 13 Regt Name appears on a Register of Claims of Deceased Officers and Soldiers from North Carolina which were filed for settlement in the Office of the Confederate States Auditor for the War Department.
