I Lemuel Cherry of the County Beafort for the province of North Carolina Planter being Verry Sick and Weak of Boddy but of Sound mind and memmory Praised Be allmity God but Caling to mind the mortality of My Boddy and knowing that it is apointed for all men once to Die do make ordain Constitute and apoint this to be my Last Will and Testament that is to Say my Soul I Bequeath to God that Gave it to me my body I commit to the Earth to be buried In a Christian Like manner nothing Doubting but at the General Resurection at the Last Day I that Receive the Same again by the myty power of God and now touchin Such Worldly Goods as has Pleased God to Bless me In this Life first I desire that all my just Debts and any funerall Charges be fully paid Discharged and Satisfied and my Legacies paid the rest Remainder and Residue of my Estate and Worldly Goods I Devise and Dispose In manner and forme follows: Item to my Well Beloved Daughter Mary Cherry I Will and Bequeath my negroe Girl named Joan and one feather bed. Item to my Beloved Daughter Rebecah Hodges I Give and Bequeath my negroe boy named Ben. Item to my Beloved Son John Cherry I will and Bequeath my manner plantation and my negroe mannamed Jeam together with my Gold Sleave buttons and the one half of my Wearing aparrel and one set of Coppers Tools. Item to my Beloved Daughter Courtney Cherry I Will and Bequeath my negroe Girl named Rose. Item to my Beloved Son Wm Cherry I will and Bequeath my negroe boy named Sutton and one message or tract of Lane Lien [lying] over the Bever Dam Containing fore hundred acres and the other half of my Wearing apparel together with my Silver Shoe buckles. Item to my Beloved Son Cader Cherry I will & bequeath one missage or Tract of Land on the south side of Brury Swamp containing two hundred and fifty acres. Item to my beloved Son Charles Cherry I Will and bequeath one missage or Tract of Land lying on the meado [meadow] branch. Further more it is my Will that the Succeeding Issues of my two negroes Wommen Maryann and Rachel at the Expiration of fifteen years from the Date herof I Give and Bequeath to my ten youngest Children, thare names is as folows: Charles Cherry, Elisabeth Cherry, Cader Cherry, Samuel and Solomon Cherry, Abigail Cherry, Lemuel Cherry, George Cherry, Willis Cherry, Patience Cherry. Furthermore It is my Will that my ten youngest Children aforementioned may inherit the Succeeding Issue as thare Birthright follows the oldest of the Succeeding Issue as they Shall in age one after other and in case of mortality of any of these my ten Children aforementioned the Issue intended may be divided among the Remainder; and further more It is my Will if no such issue arise from my two negroe Women aforementined that then and in that case to be an Equal Division of these my two negro Women; further It is my Will that if Issue Enough arises at any term of time the Number Amounting to Eight that then and in that case It is my Will my negro Woman named Maryann Shoud be Given with her Increase to my Beloved Son Willis Cherry and my other negroe Woman named Rachel to my Beloved Daughter Patience Cherry With the Increase aforementioned hereafter arising. The Rest Remainder and Residue of my Estate and Worldly Goods Chathels Cattel household furniture and all other Goods & Chattels to me for any wifes Belong or aper-taning not Divided To be Equaly Divided among my fifteen Children aforementioned. I Do nominate Chose and apoint my Beloved Son John Chery and Wm Willis to be Executors of this my Last Will and Testament and I further Will and Desire there may be no misinterpitations or Wrong Constructions put on this my Last Will and Testament That It may be understood. Sined Sealed Published and Declared this foreteenth Day of July In the year of our Lord God Everlasting one Thousand Seven Hundred and fifty fore. Lem'll Cherry Wm Willis Griffin Floyd Ashe Peter Floyd Beaufort County At a Court held at Bath Town in the second Tuesday in September 1754 Present His Majestys Justices The last Will & Testament of Lemuel Cherry was exhibited into Court and proved by the Oaths of Ashe Peter Floyd one of the subscribing Evidences thereto who swore that the said Lemuel Cherry was of sound & disposing mind & memory at the time he acceeded to the Will & that he also saw William Willis & Griffin Floyd the other subscribing Witnesses set their Hands thereto at the same time. And Wm Willis & John Cherry appeared in Court and qualified as Exec'rs. to the same. It is ordered that the Secretary have Notice hereof that Letters Testamentary may issue. Test.
