This file was contributed by: Gerry Seymour Apr 2000 ========================================================================== Beaufort County Will Book 2, pages 165-167, Beaufort County, NC WILL OF JOANNA DOWNS In the name of God Amen Know ye that I Joanna Downs of the County of Beaufort, and State of North Carolina, do make and ordain this my last will and Testament, after the payment of my just debts, I give and bequeath to my daughter, Mary Cutler one dollar. I give and bequeath to my Daughter Susan Downs and my son Britton E. Downs all my land, House Hold and kitchen furniture, Farming implements and Stock of every kind, to be equally divided between them to dispose of as they may think proper. And I appoint Britton E. Downs executor to this my last will and testament signed sealed and published, by the above named Joanna Downs as for her last will and testament in the presence of us who subscribed our names her to and in the presence of said testator and in the presence of each other, this the Twentieth of Feby 1879. Butler Joanna (x) Downs State of North Carolina Beaufort County A paper writing purporting to be the last Will and Testament of Joanna Downs is exhibited before me the undersigned Clerk of the Superior Court of Beaufort County, Britton E. Downs the executor therein mentioned and of the due execution thereof by the said Joanna Downs is proven by the oath and examination of J. H. Butler one of the subscribing witnesses thereto, who being duly sworn deposes and says that he is a subscribing witness to the paper-writing now shown him purporting to be the last Will and Testament of Joanna Downs that the said Joanna Downs in the presence of this deponent subscribed her name at end of said paper-writing now shown as aforesaid and which bears date of 20 th day of February 1879. And this deponent further saith that the said Joanna Downs did at the time of subscribing her name as aforesaid declare the said paper-writing so subscribed and exhibited to the her last Will and Testament and this deponent did thereupon subscribe his name at the end of said Will as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith that at the time when said testator subscribed her name to the said last Will and Testament and at the time of Deponent's subscribing his name as an attesting witness thereto the said Joanna Downs was of sound mind and memory and of full age to execute a Will and was not under any restraint to the Knowledge, information or belief of this deponent. The said paper-writing purporting to be the last Will and Testament of Joanna Downs, deceased is further proven by the oath and examination of W. O. Ellis who says that William W. Galloway one of the subscribing witnesses to the aforesaid Will is dead, and it is further proven by the oath and examination of W. O. Ellis and J. H. Butler that they are well acquainted with the hand writing of the said William W. Galloway having often seen him write and that the name of the said William W. Galloway subscribed as an attesting witness to the said last Will and Testament is in the proper hand writing of the said William W. Galloway. Severally sworn and subscribed this the 2nd day of Dec. 1898, before me. W. O. Ellis J. H. Butler Geo. W.
