This file was contributed by: Gerry Seymour Jan 2000 ========================================================================== Old Wills, pages 467-468, Beaufort County, NC WILL OF EVERARD WARREN I, Everard Warren, of the County of Beaufort and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existance do make and declare this my last Will and Testament in the manner and form following, that is to say. First That my Executor hereinafter named shall provide for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses together with my just debts. Item. I give and devise to my son Ferny Warren the sum of One Dollar. Item. I give and devise to my son Elias Warren the sum of One Dollar. Item. I give and devise to my son Arden S. Warren the sum of One Dollar. Item. I give and devise to my son Thos. J. Warren the sum of One Dollar. Item. I give and devise to my beloved Wife, Elizabeth D. and her children namely Abosharby(?) Ann, William H., Sarah Barbary and Elizabeth P. being the children of my present Wife, all my property of every kind, consisting of house-hold and kitchen furniture cash notes and accounts. And Lastly, I do hereby constitute and appoint my beloved Wife, Elizabeth D. Warren my lawfull Executrix to all intents and purposes to execute this my last Will and Testament according to the true intent and meaning of the same and every part and claims thereof, hereby revoking and declaring utterly void, all other Wills and Testaments by me heretofore made. In witness whereof, I the said Everard Warren do hereunto set my hand and seal this the 21st day of August 1889. Signed, sealed, published and declared by the said Everard Warren to be his last Will and Testament in the presence of us who at his request and his presence do subscribe our names as witnesses thereto. In the Superior Court A paper purporting to be the last Will and Testament of Everard Warren, deceased is exhibited before me the undersigned Clerk of Court by Elizabeth D. Warren the Executrix therein mentioned, and the due execution thereof by the said Everard Warren, by the oath and examination of J. W. Allegood and O.H.P. Tankard the subscribing witnesses thereto who being duly sworn, doth depose and say and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him purporting to be the Last Will & Testament of Everard Warren. That the said Everard Warren in the presence of this deponent subscribed his name at the end of said paper- writing which is now shown as aforesaid and, which bears the date of the 21st day of August, 1889. And the deponent further saith: That the said Everard Warren the testator aforesaid did at the time of subscribing his name as aforesaid, declare the said paper-writing so subscribed by him and exhibited, to be his last Will and Testament and this deponent did thereupon subscribe his name at the end of said Will as an attesting witness thereby and at the request and in the presence of the said testator. And this deponent further saith That at the said time when the said testator subscribed his name to the said last Will as aforesaid and at the time of deponents subscribing his name as an attesting witness thereto, as aforesaid the said Everard Warren was not under any restraint to the knowledge, information or belief of this deponent and further this deponents say not.
