Know all men by these presents that I Peter G Yeates of Beaufort County North Carolina being in feeble health, but of sound disposing mind and memory have thought proper to make, this to be my last will and testament disposing of what worldy goods i hath pleased Almighty God to bless me with in manner and form as follows. Item 1 I lend unto my beloved wife Lavina Ann, during her natural life, a tract of land containing about two hundred acres, called the Mouth of the Creek land, and also, a part of another tract called the Joshua Ecklin tract, my said wifes part to begin at the road at the termination of the Mouth of the Creek tract, and then to line with the road, to where the same forks, then with the fork which leads around my old plantation until it strikes Pritchetts line, then with said Pritchetts line to Martins gut, then down said gut, until it intersects, the line of the preceeding tract, and then to the beginning - I also loan unto my beloved wife, all of my beds bedsteads and furniture, one table, and all my setting chairs also all of my kitchen furniture also my mare also one cart and gear, one plough and gear, one cutting axe and all my weeding hoes, one sow and pigs, one cow and calf, I also give her twenty barrels of corn, and enough of my crop and provisions on hand for one years support for herself and family, including necessaries which are to be furnished by my executor. Item 2 I give and bequeath unto my daughter Sophia and to her husband William G. Gaskill, one tract of land called the Joshua Hill tract, supposed to contain one hundred and seventy acres to them and their heirs forever. My will and desire is that all my negroes together wth the balance of my land, shall be hired and rented out annually by my executor until my youngest child shall arrive to the age of sixteen years, and out of the proceeds of the same I devise that my executor shall support and educate my young children in a manner suitable to their condition in life. I desire my children to remain with their mother, until they are of sufficient size to provide for themselves. Item 3 I devise that all my chattle property not herein before disposed of shall be sold by my executor together with my Seine beaches, and all the fixtures and appertenances to the same, on a credit of six months, and that after paying all my judt debts, he shall hold the surplus at interest, until my youngest child shall arrive to the age of sixteen years, at which time I give all my negroes and all the money's that may remain in the hands of my executor to be equally divided between all my children that may then be living, and the lawful issues of any that may be dead - and my lands that I have not disposed of at the time my youngest child arrives to the age of sixteen years, I give to be equally divided between my eight youngest children, and at the death of my wife, I give all the property both real and personal, which I have loaned to her to be equally divided between my eight youngest children. Item 4 I hereby constitute and appoint William G. Gaskill, testementory, guardian to all my wife and children, and invest him with power to manage, both their persons and property according to his judgment for their best interest. Item 5 Lastly I nominate constitute and appoint guardian William G. Gaskill, excecutor to this my last will and testament, according to the true interest and meaning of this will. signed sealed published and declared to be my last will and testament on this the 26 day of December 1851.
