Clerk ========== 1754 Bertie County Civil Papers 010.325.3 NCArchives Cathy Hart Farris Jan. 2002 (there are four records with different dates all pertaining to the same case...cathy) Bertie county May Court 1754 3 March 1754 Needham BRYANT late of Bertie County aforesaid Planter was attached to answer David JERNIGAN of a Plea of Trespass on the case; And Whereupon the said David by Thomas BARKER his attorney Complains that whereas the said Needham on the Third day of March in the year of our Lord one Thousand seven hundred and fifty four at Bertie County aforesaid was Indebted to him in the sum of nine pounds five shillings Virginia money before that time Lent laid out and expended to the use of the said Needham at his Special Instance and Request; An being so Indebted he the said Needham in consideration thereof afterwards to wit on the day and year aforesaid assumed and faithfully promised to pay to the said David the aforesaid __? pounds five Shillings when he should be the__? afterwards required; Yet the said Needham not regarding his promised and assumption aforesaid But contriving to defraud the said Pltf. the said sum of money or any penny thereof to the said Pltf. __? often thereto required hath not yet paid But the sums to pay, hath hitherto refused and doth yet refused to the Pltfs Damages ten pound Lawfull money of Great Britain, And thereof he brings suit and so forth. Copy Benjamin WYNNS Clerk Whereas in the suit brought by David JARNAGAN against Needham BRYAN now in the county of Bertie depending-- At a court holden for said county at the Court House thereof on the 22 day of July Anno Dom 1755. It was then and there by the consent of the parties refered to the arbitrement and examination of John HARRELL Esquire and Joseph HARDY and their award returned to our Court to be a rule thereof. Copy Benjamin WYNNS Clerk David JARNAGAN vs. Needham BRYAN} Rule or order of Court for Settlement copy Pursuant to the rule of Court hereunto annexed, we have examined the acct in Difference, between the Plaintif and Defendant in the said suit and do find that the said Needham BRYAN the Deft is indebted to the said David JERNIGAN the Plaintiff in the sum of Three pounds five shillings Virginia Currency. (Equal in Value to three pounds nine shillings and four pence proclamation money.) We therefore and afirm that the said Needham BRYAN the Defendant do pay the said David JERNIGAN the Plaintif the said sum of Three pounds nine shillings and four pence proclamation money and the costs of the said suit Given under our hands and seals this 31st day of October 1755.
