A True bill [of indictment] Thomas Collins Foreman [of grand jury] Elizabeth Newbern William Newbern John Perry Jarvis B. Morris Nathaniel Jernigan Martin White George Morris State of North Carolina Superior Court of Law Bertie County Term 3rd Monday of September 1837 The jurors for the State upon their oath present, that King Mitchell, late of the County of Bertie in the State of North Carolina, labourer, not having the fear of God before his eyes, but being moved and seduced by the instigation of the devil, on the tenth day of April in the year of our Lord one thousand and eight hundred and thirty seven, with force and arms in the County aforesaid, in and upon one William Jernigan, in the presence of God and the State, then and there being, feloniously, willfully and of his makin[g] aforethought, did make an assault; and that the said King Mitchell, with both his hands and feet, the said William Jernigan to and against a plank floor, then and there feloniously, wil[l]fully, and of his makin[g] aforethought, did cast and throw; and that the said King Mitchell with both the hands and feet of him the said King Mitchell, then and there, and whilst the said William Jernigan was so lying upon the plank floor, the said William Jernigan in and upon the head, right breast, left breast, right side, left side, right shoulder, left shoulder, back[,] stomach, neck and face of him the said William Jernigan, then and there feloniously, wil[l]fully and of his makin[g] did strike, beat and kick, giving to the said William Jernigan, then and there, as well by the casting and throwing of him the said William Jernigan to the plank floor, as aforesaid, as also by striking, beating and kicking the said William Jernigan in and upon the head, right breast, left breast, right side, left side, right shoulder, left shoulder, back, stomach, neck and face of him the said William Jernigan with both the hands and feet of him the said King Mitchell in manner aforesaid several mortal bruises in and upon the head, right breast, left breast, rights side, left side, right shoulder, left shoulder, back, stomach, neck and face of him the said William Jernigan; of which said several mortal bruises, the said William Jernigan from the said tenth day of April in the year aforesaid, until the seventeenth day of the same month of April in the year aforesaid, in the County aforesaid, did languish and languishing did live, in [until?] which said seventeen day of April in the year aforesaid, the said William Jernigan, in the County aforesaid, of the said mortal bruises died: and as the Jurors aforesaid, upon their oath aforesaid, do say, that the said King Mitchell the said William Jernigan in manner and form aforesaid, feloniously, wil[l]fully, and of his makin[g] aforethought did kill and murder: against the peace and dignity of the State.
